Session 1724, Minutes
May 18, 1998

Mr. Lieberman wanted to congratulate the owners for operating a fine and successful
operation and wished them well in the future.

The motion carried unanimously.

AGENDA #7: PUBLIC HEARING - LIQUOR LICENSE - 7555 OLIVE STREET RD:

Mr. Ollendorff said that a public hearing was set at this time and place to review a liquor
license application for the former Pier 75 site at 7555 Olive Street Rd. They have a
completed application which has been modified from an earlier application. The
applicant is Lisa Marie Reed. Public hearing notices had been appropriately posted.
The applicant has met with the neighbors and have talked with them about their
concerns. There are no other interests in this operation but Ms. Reed. The site plan
has been reviewed and the applicant has agreed to put up a wooden fence to shield the
neighbors, will restrict entrance to the club to age thirty and over, will have regular trash
pick up, they will have adequate security both inside and outside to protect the
neighbors and to enforce the liquor laws. The applicant has indicated that she would
be willing to apply for a conditional use permit in order to have enforceable restrictions.

Mayor Adams declared the public hearing open. There were no requests to speak from
the public.

Mr. Lieberman said that it was his understanding that this operation had been closed for
some time. Mr. Ollendorff said that he was correct, that it had been closed for at least a
year. Mr. Lieberman asked if they would then qualify for the Council policy of operating
as a restaurant for six months prior to the liquor license. Mr. Ollendorff said that no,
because the location has had a liquor license in the past and secondly, the applicant
has experience in this type of business. Mr. Lieberman inquired about the conditional
use permit. Mr. Ollendorff asked Mr. Gregory Rose, Assistant City Manager, to brief
Council concerning this question.

Mr. Gregory Rose said that he had several meetings with the applicant and the
residents and, at each time, the applicant had indicated a willingness to go through the
conditional use permit process, even though a conditional use permit is not required for
this building.

Mr. Munkel said that in the information he was provided, there are letters signed by
former corporate officers, but asked if anything had been received verifying this status
from the Secretary of State's office. Mr. Ollendorff said that the former officers had
officially withdrawn their interests in the business which is reflected on the modified
application, but no official verification has been received by the Secretary of State.
