Session 1724, Minutes <br />May 18, 1998 <br /> <br />7 <br /> <br />Mr. Munkel asked how many tables they were planning to have, inside and out. Mr. <br />Felman said that currently they have seating for twenty-four outside and forty-two <br />inside. Mr. Munkel asked if the outside area would remain open in the winter. Mr. <br />Felman responded that they have a heating unit on the patio and they are debating <br />whether or not to leave it open. They certainly would not have as many tables out there <br />as in the warmer months in any case. Responding further to Mr. Munkel, Mr. Felman <br />said that they would be willing to have waitress service, such as if they ordered it and <br />they wanted it delivered, then it would not be a problem. <br /> <br />Mayor Adams declared the public hearing closed. <br /> <br />Mr. Lieberman moved approval of the liquor license. Mr. Wagner seconded the motion. <br /> <br />Mr. Schoomer asked how the City Manager would intend to enforce the waitress <br />service at this location. Mr. Ollendorff said that it was not clear to him how he could <br />enforce it. Mr. Schoomer asked if this could be made a requirement of the site plan. <br />Mr. Ollendorff replied that he still was not sure he could enforce it even if it was a site <br />plan requirement, because with many of the restaurants, a customer can buy a drink <br />and take it out on the sidewalk. Mr. Ollendorff said that he was not saying that he could <br />not enforce it, but he is not comfortable guaranteeing that he can. <br /> <br />Mr. Lieberman said that since these tables were on their private property and not on the <br />public right-of-way, then anybody that walks off their property with a drink is violating a <br />City ordinance. Mr. Ollendorff responded that he did not think this was right, because <br />the City did allow people to drink on the public sidewalk. <br /> <br />The motion carried six to one. Mr. Schoomer voted Nay. <br /> <br />AGENDA #6- LIQUOR LICENSE UPGRADE - 6623 DELMAR: <br /> <br />Mr. Ollendorff said that an application has been received to upgrade the license for <br />Cafe Natasha from beer and wine to add all types of liquor by the drink on the <br />premises. The application is in order and the applicant has run a model establishment. <br />They are well beyond the typical waiting period established by the City Council for an <br />upgrade in their license. Their record is clear so Council may approve. No public <br />hearing is necessary since this is not a new license. <br /> <br />Mr. Schoomer said he could not see how to make Cafe Natasha better. <br /> <br />Mr. Schoomer moved approval of the liquor license upgrade. Mr. Wagner seconded the <br />motion. <br /> <br /> <br />
