Session 1724, Minutes <br />May 18, 1998 <br /> <br />6 <br /> <br />in for the last fifty-five years, since the home was built. They just want to really own the <br />land. <br /> <br />Mr. Lieberman said that his material said that families on both sides wish to use this <br />land and asked if this was verified by both the families. Mr. Ollendorff said that Ms. <br />deforest owns both sides and that they will maintain it. <br /> <br />Mayor Adams declared the public hearing closed. <br /> <br />Mayor Adams directed Mr. Ollendorff to prepare the proper legislation. <br /> <br />AGENDA #5: PUBLIC HEARING DATE - 6333 DELMAR LIQUOR LICENSE: <br /> <br />Mr. Ollendorff said that this was the time and place for a public hearing at which we <br />invite comments from any interested party in the proposal to sell alcoholic beverages at <br />this new restaurant location. The application is in order and appears to meet all City <br />ordinance and Council policy requirements, except that the Council typically requires a <br />period of observation after the restaurant is opened before liquor sales are authorized. <br />Exceptions have been made in the past if the applicant demonstrates a good deal of <br />positive experience in alcoholic beverage sales at other locations. The applicant meets <br />this requirement and thus qualifies for City Council approval. <br /> <br />Mayor Adams declared the public hearing open. There were no requests to speak from <br />the public. <br /> <br />Mr. Schoomer said that he feels that this may be problematic, since there is always <br />table service with full liquor and that this place has an unsupervised outside area. <br />There is no way to regulate alcohol out on the street. <br /> <br />Mr. Chris Felman, Operation Manager for Tomatillo's at 6333 Delmar, said that he did <br />not believe that there would be a problem with the control of liquor going outside of the <br />location, because the liquor is not sold as a "to go" item and is sold to be eaten with the <br />food. He said that table service could possibly control it, but as soon as the <br />waiter/waitress left, then the customer has the option of walking out. If it became a <br />problem, they would certainly address it for Council. <br /> <br />Mr. Lieberman asked if it would be feasible to make the sell of, for example, a bottle of <br />beer a table service item, if in fact they do have problems. Mr. Felman said that they <br />would definitely consider this option. It would require one extra person for that purpose, <br />but would be easy to adapt to it. <br /> <br /> <br />
