Special Session <br />February 22, 2005 <br /> <br />"Greensfleder Lane is a private street maintained by the people who live there. A <br />provision between the applicant and the street owners should be added to the Plat or a <br />separate agreement attached to and recorded with the Plat that sets forth procedures <br />for reimbursement by the current and subsequent land owners of lot A and B in the <br />event street is damaged by construction equipment and their vehicles. <br /> <br />Then there was a question as to who is responsible for adding this information to the <br />Plat and Mayor Adams explained that the City would need to approach the St. Louis <br />County offices. <br /> <br />Mike Greenwood, 7840 Greensfelder Lane, said the "whole lane" met with Dante <br />Anselmo last June (2004) where he described his plans and this question of a bond <br />came up, but no one recorded the conversations, and he promised everyone he would <br />secure a bond. Mr. Ollendorff said he can be a witness to that comment. Mayor Adams <br />said the best way to proceed legally would have to be determined. <br /> <br />Mr. Ollendorff said the earliest the Council can vote on this is March 7, 2005. Any bill <br />must be introduced at one meeting and must be held over for seven days until the next <br />Council Meeting, for second and third readings and the vote. <br /> <br />Councilmember Brot asked to be informed about the progress of setting up meetings <br />with Dante Anselmo to make sure that he keeps his word, especially as relating to the <br />streets and any other matters relating to this issue. Mr. Ollendorff said the main concern <br />is to improve the drainage situation as well as concern for the streets. Councilmember <br />Wagner has directed him to do all that he can to assist the private property owners and <br />the private subdivision and to protect the street and improve the drainage. He will do <br />what he can. <br /> <br />Mr. Wagner asked that when Mr. Ollendorff researches the topic of compensation for <br />collateral damage on private streets, please try to hold the meeting with the residents <br />before the vote on March 7th and Mr. Ollendorff responded yes. <br /> <br />Mike from 7840 Greensfelder said residents want a water study and Mr. Anselmo also <br />mentioned a water study, but there was confusion on both sides. They now propose an <br />independent water study be undertaken and nine residents on Greensfelder Lane will <br />pay for it. Can Mr. Ollendorff approach Mr. Anselmo on their behalf to have the study <br />conducted, because recently there was flooding as a result of the rain. A credible report <br />is needed because this is an important part of this issue. <br /> <br />Mr. Ollendorff said regarding the comprehensive plan and the City's enforcement, he <br />would be happy to meet with this group and others because this is a constant subject <br />before the City Council. Policies to be included in the comprehensive plan, updating of <br />the comprehensive plan and adoption and amending zoning ordinances for the next five <br />years to put "teeth" into them are all part of the process.
