Session 1725, Minutes <br />June 8, 1998 <br /> <br />Mr. Schoomer said that he viewed this as an incomplete application and Council should <br />not be discussing it. <br /> <br />Mr. Munkel asked if the City received any confirmation from the Secretary of State's <br />office regarding the two officer's resignations. Mr. Ollendorff said that he did think it <br />had been received yet and asked the Assistant City Manager to clarify. Mr. Gregory <br />Rose, Assistant City Manager, said that he had not received any information regarding <br />the ownership since the resignation of two board members. He continued by saying <br />that the owner was in the audience and could be asked about the conditional use <br />permit and the ownership status. <br /> <br />Mr. James Whitney, 8000 Bonhomme, is the attorney for the applicant, Lisa Marie <br />Reed. He prepared and filed this afternoon a conditional use application. He <br />understands that Ms. Reed is attempting to use it in the manner in which it was used <br />immediately preceding her interest in the property. The corporate attorney has <br />prepared and executed resignations of the individuals whom the Council was <br />concerned. Mr. Whitney does not believe there is a document that the Secretary of <br />State gets until the next annual registration, in which a corporation would list the <br />officers. Ms. Reed has agreed to all of the conditions as recommended and has <br />voluntarily submitted herself to the conditional use process. <br /> <br />Mr. Lieberman asked about the types of liquor checked on the application, which <br />included both "5% beer, 14% wine" as well as the "all kinds". Mr. Ollendorff said that <br />when the application was submitted, it had the beer and wine checked. This was <br />pointed out to the applicant who checked the" all kinds" afterwards, which is what they <br />want. <br /> <br />Mr. Ollendorff asked the applicant about Mr. Lieberman's question about waiting on the <br />liquor license until the conditional use permit is acted on. Mr. Whitney said that Ms. <br />Reed would be amenable to whatever the Council was comfortable with. Mr. Ollendorff <br />said that waiting for the conditional use process would mean another wait of a month. <br /> <br />Mr. Sharpe asked Mr. Ollendorff when he received the conditional use permit <br />application. Mr. Ollendorff replied that he found out about it on the way up to the <br />meeting this evening. It looks like it is in order, but the plans have not been looked at <br />and the zoning administrator has not looked at it. <br /> <br />Mr. Schoomer said that he was sure everything was is in order and that there is no <br />question of intent, but without the document before him, he does not know what he is <br />voting on. <br /> <br /> <br />
