Session 1725, Minutes 10 <br />June 8, 1998 <br /> <br />AGENDA #5: LIQUOR LICENSE SUMMER CONCERT SERIES: <br /> <br />A request for a picnic license to sell beer at the Summer Concert Series at Heman Park <br />on July 6, July 13, July 20, July 27, August 3, August 10, August 17, and August 24, <br />1998 has been submitted by the Commission on Arts and Letters. Staff has reviewed <br />the application and everything appears to be in order and ready for Council <br />consideration. Since this application is being made by one of the City Commissions, it <br />is important to note that it reflects our commitment for the City to follow its own <br />established processes and procedures. <br /> <br />Mr. Schoomer moved approval. Mr. Sharpe seconded the motion, which carried <br />unanimously. <br /> <br />AGENDA #6- 7555 OLIVE STREET ROAD: <br /> <br />A completed application for full liquor license for 7555 Olive Street Road has been <br />submitted for Council consideration. This item was tabled to this meeting. The <br />applicant and the neighboring property owners have agreed to the following conditions: <br /> <br />The applicant will erect a wooden fence on the north side of the facility to <br />shield the residential area. <br />The club will restrict entrance to ages 30 and over; <br />Routine trash pick up service will occur; <br />Adequate security will be provided inside and outside the facility. <br /> <br />The applicant just submitted their conditional use application today and it has not been <br />reviewed yet. The applicant has not provided incorporation papers from the Secretary <br />of State since the resignation of two board members. <br /> <br />Mr. Sharpe made a motion to remove this item from the table. Ms. Colquitt seconded <br />the motion. AYES: Ms. Colquitt, Mr. Wagner, Mr. Lieberman, Mr. Schoomer, Mr. <br />Sharpe, Mayor Adams. NAYS: Mr. Munkel. The issue was removed from the table. <br /> <br />Mr. Lieberman asked the City Manager if it was appropriate to deal with this issue <br />without proper review of the conditional use permit and study. Mr. Ollendorff replied <br />that he had the application. Mr. Lieberman said that was true, yet the Council or staff <br />had not seen it. The liquor license can be approved, but the establishment could not <br />operate without a conditional use permit. Mr. Ollendorff said that the liquor license and <br />the conditional use permit are independent of each other and it was not easy to say if it <br />was appropriate or not. He said that there was no legal requirement that they should <br />be approved in any particular order. <br /> <br /> <br />
