Session 1725, Minutes <br />June 8, 1998 <br /> <br />Mr. Schoomer moved denial of the liquor license application without prejudice, so that, <br />in a future date Mr. Montgomery resolves his problems with the neighbors, he can come <br />back and apply without the additional fees. Mr. Lieberman seconded the motion. <br />All voted Aye except Mr. Munkel and Ms. Colquitt, who voted Nay. The motion to deny <br />succeeded 5 to 2. <br /> <br />AGENDA ~4 - REQUEST FOR PERMIT TO SOLICIT - FUND FOR PUBLIC <br />INTEREST RESEARCH (MoPIRG): <br /> <br />The Fund for Public Interest Research is planning to conduct their annual door-to-door <br />campaign on behalf of MoPIRG (Missouri Public Interest Research Group) for the <br />period June 22 through July 10, 1998. They will collect financial contributions and <br />petition signatures. The organization has certified that the cost of raising the funds in <br />the solicitation will not exceed 25% of the total amount raised. A representative of the <br />organization has been invited to attend this meeting, should the Council have any <br />questions. Mr. Ollendorff recommends that the Council grant the permit since all <br />requirements have been met. <br /> <br />Mr. Schoomer moved approval. Mr. Sharpe seconded the motion. <br /> <br />Mr. Munkel said that the statement says that the cost of raising funds for solicitation will <br />not exceed 25%, which is a very common practice for non-for-profit groups and asked <br />the City Manager if we ever asked for proof before or after the campaign. Mr. Ollendorff <br />said that the City does not audit, but the organization does submit their financial <br />statement. <br /> <br />Mr. Lieberman said that MoPIRG has a long history and he believes there is no <br />question of them meeting their 25% goal. He is, however, against door-to-door <br />campaigning. It is not proper. He will, in no way, approve a door-to-door solicitation for <br />funds and it should not even be approved by the Council. He will vote against this. <br /> <br />Mr. Wagner said that after listening to Mr. Lieberman make this statement for many <br />years, he believes he is coming around to his way of thinking. He asked Mr. Ollendorff <br />what the darkness hour rules were. Mr. Ollendorff was not sure, but he will check it out <br />and get back with him. <br /> <br />Mr. Munkel asked if solicitations could be barred by ordinance. Mr. Lieberman said he <br />did not want an ordinance, just that it be denied. Mr. Ollendorff said that the Council <br />could not, constitutionally, pass an ordinance like that. The City can regulate, but not <br />prohibit. <br /> <br />All voted Aye, except Mr. Lieberman and Mr. Wagner, who voted Nay. <br /> <br /> <br />
