Session 172.5, Minutes <br />June 8, 1998 <br /> <br />adjustments. The condition prohibiting parking on adjacent and nearby public streets <br />has been rewritten to allow parking on McKnight Place only. <br /> <br />10. <br /> <br />Except as heretofore modified or modified by the term hereof, all conditions of <br />conditional use permit 241 and 241(a) and amendments thereto shall remain in <br />effect as to the property covered by said permits. <br />Except as same must be modified to comply with the conditions hereof, the <br />addition shall be constructed and maintained in compliance with the plans <br />submitted with the application. <br />Operation of the convenience and retail uses shall comply with the requirements <br />of Section 34-34.4 of the Zoning Code. <br />The parking areas shall be designed and constructed in accordance with the <br />construction requirements of Section 34.92.1, the vehicular access and <br />circulation requirements of Section 34.93.2 of the Zoning Code. <br />All parking for the entire development, as it presently exists and the proposed <br />addition, including without limitation, resident, guest, employee parking and <br />parking for ancillary or special events, shall be on-site and shall not be permitted <br />on any adjoining or nearby public street, except McKnight Place. It shall be the <br />obligation of the permittee to insure compliance with this requirement. <br />Lighting of all exterior areas, including all parking areas, shall comply with the <br />requirements of Section 34.93.7 of the Zoning Code, and shall be designed to be <br />compatible with surrounding areas, shall be shaded to direct light downward and <br />away from abutting uses and shall comply with the terms of the letter of Charles <br />Deutsch to Mr. and Mrs. David Freeman, dated February 18, 1998, which is <br />incorporated herein by this reference. <br />A detailed landscaping plan including fencing, saved trees and screening (in <br />particular screening of the Barby parking lot from the north elevation) shall be <br />submitted to the Director of Planning for his/her review and approval and shall <br />comply with the terms of the letter of Charles Deutsch to Mr. and Mrs. David <br />Freeman, dated February 18, 1998, as incorporated herein by reference, and <br />shall be maintained in accordance with the approved plan. <br />Drainage arrangements shall be approved by MSD and the City Public Works <br />Department. <br />Exhaust control for common kitchen, laundry and other facilities shall be installed <br />and maintained to prevent smoke and odors from being perceptible beyond the <br />property lines of the development. <br />A study shall be made by the City along Barby Lane of the possible installation of <br />additional traffic controls which may be found appropriate based on the <br />expansion of The Gatesworth. Such study shall take into account current <br />conditions on Barby Lane as well as any traffic impact generated by the addition. <br />Said study shall encompass information before, during and after the expansion. <br />The cost of the study shall be paid for by the applicant. <br /> <br /> <br />
