<br />Session 1581, Minutes <br />November 23, 1992 <br /> <br />Page 5 <br /> <br />allowed to sell Christmas trees (November 9, 1992 maeting), since trees have <br />been sold at the site for many years. Mayor Majerus said the comer has been <br />empty for a long ti1ne, but when Council awroved the establislnnent of the U. <br />city Bar-B-Que, one of the corxlitions i.np:>sed prohibited all outside sales. <br /> <br />Mrs. 'Ihompson said she received many calls fran constituents who felt it was <br />outlarxlish that Mr. Grady, the owner, could not sell Christmas trees for only <br />three weeks, after 40 years of sales at that site. She said Mr. Bell, opera- <br />tor of U. City Bar-B-Que, told her he had no objection to those sales next to <br />his business. She asked the Council to reconsider this matter. <br /> <br />Mr. Price referred to a November 18 neoo fran Mr. Ollen:iorff that discusses a <br />zoning law that allows Council to tie a corxlitional use pennit to the current <br />applicant, thus en:iing the approved use when an awlicant sells or leaves the <br />property. It said that when Council approved the U. City Bar-B-Que, approval <br />included a number of corxlitions, one of which prohibited outdoor sales. Mr. <br />Ollen:iorff confinned Mr. Price's assurcption that Mr. Bell is the holder of <br />the pennit and the one with the right to request that the pennit be amended. <br />Mr. Price also felt the lot size was not an issue, and there was enough room <br />to sell trees as a temporary use. Mr. Ollen:iorff said Mr. Bell could apply <br />for the amendment, it would go to the Plan Connnission and then to Council. <br /> <br />Mrs. Thompson said Christmas will be over before that is done and she wished <br />to know if there was any way to speed things up. Mr. Ollen:iorff was not <br />aware of any, and said the applicant should have come in last spring when he <br />became aware of the problem. <br /> <br />Mr. Adams said Mr. Grady transferred use of his property to Mr. Bell, but he <br />should have reserved part of it for his own use. Mr. Adams said Mr. Grady <br />was aware of the problem in the spring, but did nothing about it then. If he <br />wants a change next year, he must ask Mr. Bell to make the request. <br /> <br />Mrs. Schuman commended Director of Finance Willie Norfleet ani Detective Rob- <br />ert Johnson for agreeing to sponsor a wrestling club for 7th ani 8th graders <br />in connection with the Community Partnership Recreation (CPR) Program.
