'!he general use <br />is pennissible, with the following CX>l'Xlitions: <br /> <br />1. '!here shall be no stage or raised platform for entertainers am there <br />shall be no entertairnnent by live perfonners unless specifically approved <br />by the City Council as a site Plan Review AmerrlIrent. <br />2. Errployees shall Park in the area behini the roilding. <br />3. ()J,tdoor dining or seating is not pennitted. <br />4. Signs on the premises shall conform in all respects with the provisions <br />of the university city Sign Ccxle. <br />5. At no time shall cany-out food service becxma a significant portion of <br />the business. If the restaurant owner or operator desires to operate a <br />cany-out restaurant or otherwise provide cany-out food service as a <br />significant portion of the business, an application for a eorrlitional Use <br />Permit must be submitted as required by Section 34-65 of the University <br />city Zoning Ccxle am receive the express awroval of the city Plan Com- <br />mission am City Council. <br />6. Arr:l enlargement or alteration in the use of the structure as a restaurant <br />or the site for restaurant use must be awroved by the City Council urrler <br />a site Plan Review AmerrlIrent before a roilding pennit may be issued for <br />such enlargement or alteration. <br />7. Adequate refuse disposal shall be provided by am for the business. <br />8. An exhaust system shall be installed arrljor other means shall be taken to <br />prevent any food preparation mors or cooking mors fran being readily <br />perceptible beyorrl the lot lines of the property on which the restaurant <br />is located. <br /> <br />Mrs. '!hompson said Hadley's currently has live entertairnnent am outdoor din- <br />ing, am she did not urrlerstan::l why this would be prohibited at the new loca- <br />tion. Mr. Ollerrlorff said the new site is in a shopping center, while the <br />present location is a free starrling roilding with a lot of property arourrl it. <br /> <br />'!he aWlicant, Ms. Millie washington, 12914 Nimes, said nothing will change <br />at the new location, including outdoor dining, which the present c:mner has on <br />the sidewalk. '!he shopping center owner has given pennission (if Council ap- <br />proves) to use the sidewalk am several Parking spaces for an outdoor patio <br />(8 tables), with the entrance to this area through the restaurant. She said <br />this would not i1rpede traffic or block the sidewalk. She would like to have <br />a combo but not a regular ban::i as the current operator has had, am agreed <br />there would be no stage. She was also concerned about eorrlition No.5. <br /> <br />Resporrling to Mr. Sdloarer, Ms. washington said there was no relationship be- <br />tween herself am the present operator, who has filed for bankroptcy. <br /> <br />Mr. Wagner, noting the constraints :inposed by the city, asked Ms. washington <br />what attracted her to this location. She said the site was ahrDst twice as <br />large as the present one, which her business has outgrown. <br /> <br />Ms. washington was asked what corrlitions she would like changed. She wanted <br />
