Session 1574, Minutes
July 6, 1992

Page 7

the root beer's consistency would suffer if the machi.nel:y was stqJped am re-
started, but it could be slC1NE!d down sc:.me, although he was not sure how much.
He said 50 cases an hour was maximum, not minimum.

Mr. Schoener thought it was better to put the limitations in rn.nnbers rather
than percentages so that all will kr1<::M exactly what is involved.

Mr. Ollerrlorff said the percentage was suggested by the awlicant, am in
tryin] to :relate that to rn.nnbers, the awlicant expected to sell $600,000 in
food am $150,000 in other activity; 10% of that total seemed reasonable. In
order to enforce the restrictions he proposed, all three elements in the meIOO
should be adopted; however, Council should decide what the restrictions are.

Mr. Wagner agreed with Mr. Schocmer about usin] figures rather than percent-
ages, am he felt Council's wishes could be met by limitin] the total rnnnber
of cases Per week, urrlerstarili.ng that the percentage will fluctuate.

In response to Mr. Adams, Mr. Richman said the projected rnnnber of daily pa-
trons at the restaurant is 300.

Mayor Majerus felt it would be better to start conseJ:Vatively due to the spe-
cial nature of this project am because of Special Business District corrnni.s-
sion CO:ncen1S.

Mr. Schoener asked about the impact for any one of the three corrlitions, not-
in] that only one truck a day may operate fran the buildinJ, there is no pol-
lution, noise, or odor, am no impact on Delmar. Mr. Ollerrlorff said one way
to measure the impact of the 400 case figure is that it anounts to $250,000
gross, an annmt bigger than all but four restaurants in the loop right now.

Mr. Adams raised the question of whether the final rnnnber would be absolute
or an average, am it was decided it should be average.

Mr. Wagner IOClVed that the constraint on bottlin] be limited to the first con-
dition only, am that the rnnnber be 600, on average. Mrs. 'lhCll1pSOn secorrled
the notion.

Mr. Price suggested that the notion include a Jilrase statin] that bottlin]
may be done only if the restaurant is operatin]. Mr. Wagner acx::epted that
amen::hnent to the notion, as did Mrs. 'lhCll1pSOn.

Mrs. Schlmlan felt that sc:.me percentage of the bottlin] should be designated
retail. Mayor Majerus agreed, suggestin] Council seemed to have forgotten
this should be considered a retail operation. Mrs. Schlmlan asked Mr. Wagner
if he would amerxl his notion to include that no llDre than half (300 cases a
week) would be sold wholesale. He would not accept the amen::hnent, pointin]
out it would severely limit wholesale sales if many fewer cases were sold
retail. Mrs. Schlmlan then IOClVed to amerxl the llDtion by ac:ldin;J that of the
600 cases to be bottled, half (300) may be wholesaled even if 300 cases are
not sold at retail. Mayor Majerus secorrled the notion.

Mr. Price felt the main consideration should be protection of the buildinJs
