Regular Meeting <br />February 14, 2005 <br /> <br />every business within the community to do that. She would be more in favor of <br />encouraging such responsibilities of all businesses in U. City, but she questions whether <br />it is appropriate to attach that condition to one. She would feel better that we request <br />that the owners strongly consider and offer the city’s help in making that happen. <br /> <br />Mayor Adams asked if a spokesperson for the applicant would like to respond to the <br />proposed amendment and Sandy Stevenson, 512 Vernal Hill Court, Ballwin, MO 63021, <br />agreed with the amendment and said she will agree to consider the recycling, but does <br />not want it to be a condition on the permit. Ms. Brot then asked how she could withdraw <br />her “second to the motion” and Mayor Adams explained that she could remove her <br />second or call for the question with the idea of defeating the amendment. Then she <br />asked, “what if I want to have it suggested?” and was told that it would have to be dealt <br />with following the amendment. She called for the question. Mayor Adams asked if she <br />was calling for its defeat and she responded yes. Mayor Adams called for the vote and <br />since there were one aye vote (Mr. Wagner) and six nay (Ms. Colquitt, Ms. Brungardt, <br />Ms. Brot, Ms. Welsch, Mr. Sharpe, and Mayor Adams) votes, Mr. Wagner’s proposed <br />amendment was defeated. <br /> <br />For clarification, Mayor Adams reiterated there had been a motion made by Ms. Welsch <br />to accept this proposal with only the conditions recommended by the Plan Commission <br />and not the additional conditions proposed by Mr. Ollendorff. Mr. Ollendorff said that <br />whether or not the condition is there, he wanted to make it clear that as City Manager <br />he is giving notice there is an on-site parking requirement in the zoning ordinance that <br />the City Attorney will interpret for the City. Whether the Council approves the condition <br />or not, does not change the fact that there may be a parking requirement that will have <br />to be met in order to obtain plan approval. Mayor Adams asked if everyone, including <br />the applicants, understood what had just been said. <br /> <br />The question to approve the conditional use permit for 6602 Delmar with only the <br />original conditions as approved and recommended by the Plan Commission was called. <br />The motion carried six to one, with the Nay being offered by Mr. Wagner. <br /> <br />Ms. Welsch commented to Mr. Wagner that she would like to talk to him about setting <br />up a recycling protocol for all businesses within the City and Mr. Wagner agreed, stating <br />that it is long overdue. <br /> <br />RESOLUTIONS <br /> <br />1. Application for Grant for U. City Loop Streetlights <br /> <br />Ms. Welsch introduced this Resolution and Ms. Brungardt seconded the motion. <br /> <br />Ms. Brungardt said that a number of businesses in the Loop Special Business District <br />are writing letters of support for this grant as are a number of neighborhood <br />Page 6 <br /> <br />
