Regular Meeting <br />March 7, 2005 <br /> <br />The roll call vote was as follows: AYES: Mr. Wagner, Ms. Brot, Ms. Welsch, Mr. Sharpe, <br />Ms. Colquitt, Ms. Brungardt and Mayor Adams: NAYS: none. Bill Number 8757 passed <br />unanimously and became Ordinance 6528. <br /> <br />4. Bill No. 8759 - AN ORDINANCE APPROVING A FINAL SUBDIVISION PLAT OF <br />A TRACT OF LAND TO BE KNOWN AS “BOUNDARY ADJUSTMENT AND <br />SUBDIVISION PLAT OF PART OF LOT 32 OF CENTRAL SUBURBS ST. LOUIS <br />COUNTY, MISSOURI” AND LOCATED AT 7823 GREENSFELDER AND THE <br />WESTERN 18 FEET OF 533 WARDER. <br /> <br /> The Bill was given its second reading. <br /> <br />Tom Harig, 7814 Greensfelder Lane, said something is wrong when both the Planning <br />Commission and the City Council vote against this re-subdivision and now tonight’s <br />impending vote. Something is wrong when the main criteria for meeting the zoning <br />requirements are not the houses on the street directly affected by this re-subdivision, <br />but houses located on other streets as far away as Delmar Boulevard on the north and <br />Teasdale Avenue on the west. He said he can throw a horseshoe from his front yard <br />and hit the yard at 7823 Greensfelder, the re-subdivision lot. It takes him two to three <br />minutes to walk from his home to Delmar Boulevard. Something is wrong when the City <br />Council has to reverse itself because of a law suit in the knowledge that this law suit, <br />based on passed experience, would result in a loss for University City. Why haven’t <br />steps been taken to address the shortcomings in the zoning code so that law suits <br />would not be the order of the day, or if so, they would be “winnable.” Something is <br />wrong when we read in various official City publications that were mentioned tonight <br />about neighborhood’s integrity, but they turn out to be just words. A developer who is <br />not here tonight, and even his lawyer who is having a little sidebar, will win over the <br />residents who are here tonight. I still have to say “thank you” to Councilmember <br />Wagner who has gone way beyond the call of duty to be supportive and helpful, and for <br />that I thank you publicly. For me, it has been a fight, but it is not over yet. If memory <br />serves correctly, a famous philosopher from The Hill said, “It’s not over until it is over.” <br /> <br />Mike Greenwood, 7840 Greensfelder Lane, thanked the City Council for their hard work <br />and support in this issue. He brought up the issue of Council approval of a final <br />subdivision, stating that the property must meet City requirements. In order to meet <br />them, he asked if there has been a completed transaction for public record of the sale of <br />Manning’s 18 feet of property to Anselmo. No one on Council, staff or attorneys present <br />in audience seemed to know. Greenwood asked again, “Has there been a public record <br />of the sale of the eighteen feet?” and Eric Schmitt, from the audience, responded “he is <br />the owner under contract – that is all he knew. <br /> <br />Ms. Brot asked if Mr. Anselmo is the “owner under contract” and Mr. Schmitt replied <br />yes. Mr. Greenwood continued by saying that Dante Anselmo is the owner of the lot, but <br />that he had referred to a strip of 18-foot land. Mr. Greenwood said he questioned <br />Page 10 <br /> <br />
