Regular Meeting <br />April 11, 2005 <br /> <br />Agenda Item # Three – Conditional Use Permit 8041-8081 Olive: <br /> <br />Mr. Ollendorff advised that a conditional use permit was held over from the previous <br />City Council meeting for a project at the Farmer’s Market construction proposal for 8041 <br />Olive through 8081 Olive Boulevard and that project includes frontage on Hafner, The <br />conditional use permit has been the subject of several different public hearings and <br />meetings and is recommended by the Plan Commission and the planning staff. Some <br />issues were raised, but were not of significant importance to recommend denial, but the <br />applicant has agreed with the concerns, has amended his plan: 1) to provide five more <br />parking spaces making a total of 175 spaces instead of 170, and 2) to close the drive- <br />way into and out of Hafner, so that residents there will not have to be bothered by <br />commercial traffic, so with those changes he recommended that Council approve this <br />conditional use permit. The project itself, in principle, has been approved by the Council, <br />and this approval this evening attaches conditions that the site could be covered up to <br />79 per cent buildings, that there be an approved storm drainage facility, that the shared <br />access driveway between the various commercial occupants be subject to design <br />review by the city, that the loading area be screened and that the permitted parking <br />variance to one hundred seventy-five spaces be approved. He advised that the <br />ordinance requires 180 spaces, unless there is substantial public transportation. In this <br />case, there is a bus stop in front of the building, which is within the authority of the <br />Council to grant a variance of five spaces from the parking requirements. So with all <br />that, he recommended approval. <br /> <br />Ms. Colquitt deferred to the residents speaking first. <br /> <br />Mr. Sharpe said his concern was that residents requested at the last Council meeting <br />that they meet with developers prior to this meeting, and for some reason, there has <br />been no meeting. He would like to see this item tabled until this is done. Mayor Adams <br />asked him to detain tabling until residents had the opportunity to speak and he agreed. <br />Ms. Colquitt added that a meeting was held among the residents, but the developer did <br />not attend to explain his intentions to them. That meeting has not been held, she stated. <br />Mr. Wagner mentioned a point of information and then asked if this item had been <br />tabled last time and was told my Ms. Colquitt that it was. Mayor Adams said he was not <br />sure that it had been exactly tabled so much as held over to the next meeting because <br />of the issues mentioned by the City Manager. Ms. Colquitt thought that she had officially <br />tabled it. <br /> <br />Ms. Meine Forsythe, the City Clerk said that she would quickly research the minutes <br />from the last meeting to verify the action taken by the Council. <br /> <br />Mr. Ollendorff said that Mr. Wagner’s point was that if it had been tabled, there must be <br />a motion to take it off the table so that it can be discussed and Mr. Ollendorff said he did <br />not recall if it was just held over or tabled.
