Ms. Colquitt, Ms. Welsch and Mr. Sharpe and those voting NAY were Ms. Brungardt, <br />Mr. Wagner, Ms. Brot and Mayor Adams. The motion to table failed four to three. <br /> <br />Ms. Welsch commented that this is a difficult situation. MSD has been contacted <br />over a period of thirty to thirty-five years to resolve this issue. It is not <br />fair to hold up one development until that problem is solved. More pervious <br />surfaces can be added. The City Staff will work with the developer to reduce <br />noise and traffic issues. These issues concern problems with MSD and can't be <br />controlled by the City and should not hold up development. If this happens, <br />there will be not be development along the river. <br /> <br />Mr. Sharpe said that problems with back-flow can be solved with backflow valves, <br />and if that is done, the development should not affect the flooding. As for the <br />children, he still wants to see mixed-use in the City. He said the neighbors <br />might be surprised at how well this will work. <br /> <br />Ms. Colquitt added that neighbors were not opposed to the development, but they <br />were opposed to major issues not being addressed, because no one from the <br />development team came to work with them. She said they had many questions that <br />weren't addressed to their satisfaction. <br /> <br />Ms. Brungardt stated that Hafner Place and Wilson Square face similar flooding <br />problems. She understands that this is a tremendous burden on these <br />neighborhoods to bear. She believes; however, that this development should not <br />bear negatively on the existing issues of this neighborhood. She hopes that <br />everyone will continue to work diligently together to help resolve these issues. <br /> <br />Mayor Adams said that since it looked like this project would be approved, he <br />wanted to make sure that when the Council looked at future economic development, <br />that the total burden of economic development is not placed on just one segment <br />of the city. The entire City should receive the same treatment and there should <br />be a concerted effort to do so. <br /> <br />Ms. Brot asked the Mayor to repeat the motion and he said that the motion was to <br />approve the conditional use permit on 8041-8081 Olive. The motion was made by <br />Mr. Wagner and seconded by Ms. Brot. The motion passed with six AYE votes and <br />Ms. Colquitt voting NAY. <br /> <br />Agenda Item # 5 - Liquor License - Tivoli Theater <br /> <br />The application for alcoholic beverage sales at 6350 Delmar is in order and may <br />be approved by City Council. The applicant has a clear record and the site <br />should not present any problems. <br /> <br />Ms. Brot moved approval and Ms. Welsch seconded. <br /> <br />Ms. Brot stated that every time we have talked about sale of liquor there has <br />been a food requirement. Up and down Olive there are many places where people <br />can get alcoholic beverages, and she personally does not want to go into a <br />theatre and sit next to someone who has been drinking a lot and only having <br />popcorn. What does this two hundred and thirty thousand dollar food item mean; <br />what kind of food are we talking about and is that enough food for Council to <br />approve this? Mr. Ollendorff said he did not have any information about it. She <br />would like to hear some arguments in favor of it. <br /> <br />Ms. Welsch said she thought that with liquor licenses, most of the sales should <br />be from food, and added that she wonders how this would impact other businesses <br /> <br />
