<br />The motion passed unanimously. <br /> <br />AGENDA ITEM # 2 – CONDITIONAL USE 6680 DELMAR: <br /> <br /> <br />Mr. Ollendorff continued to say that this conditional use permit is presented <br />for Council approval and the Planning Commission recommended that it be <br />approved. It is for a business located at the corner of Kingsland and Delmar and <br />it is in the zoning for the U. City Loop. On the Delmar corner, the first floor <br />must be a comparative retail shop or a restaurant~entertainment type use, <br />anything else must come before the City Council for approval. Since this is a <br />non-retail business, it must get Council approval. He recommended it but with <br />these conditions: signs, litter control including adjacent public property, <br />refuse containers, business hours limited to 9 a.m. to 1 a.m. Mr. Ollendorff <br />said he wanted to point out specifically that the seating is limited to what is <br />specified in the application and this is because the number of seats relates to <br />the parking requirement. <br /> <br />Mr. Wagner moved approval and Ms. Brot seconded, and the motion passed <br />unanimously. <br /> <br />Ms. Welsch wanted to go on record saying that she is glad to see this business <br />established in the Loop and that it is beneficial to citizens. <br /> <br />Mr. Wagner commented that this business is a tremendous improvement over what <br />was there previously. He noted that they sell "services which is a kind of <br />retail." <br /> <br />Ms. Brot said she was very impressed with the procedure that the franchisee had <br />gone through to develop this and place it in University City. She does have a <br />question regarding the eighteen parking spaces. Given their location, they are <br />so close to so much on-the-street parking, and you don't really have to sit down <br />to eat. Do we have to limit them to eighteen and is this the maximum that we can <br />allow? Mr. Ollendorff responded that it was the maximum. Ms. Welsch said they <br />can return to the City Council to get a variance for parking if their business <br />grows. <br /> <br />Mr. Wagner said this issue was raised at the Planning Commission and the answer <br />from the applicants were with the number of staff they are planning, this is the <br />right number of customer seats they need for the computer sections they have. <br />Ms. Brot said their plan talked about 1500 to 2000 new computers in just a <br />couple of years and she thought that they might need more that. <br /> <br />Mr. Wagner corrected her, saying 18 was the number of parking spaces, not of <br />seats, and Mayor Adams added that it was the minimum number of parking spaces <br />required at that location. <br /> <br />The motion passed unanimously. <br /> <br />AGENDA ITEM 3 - Public Hearing - Annual Budget <br /> <br />A public hearing has been called for this time and place for citizens to comment <br />on the budget for the fiscal year starting July 1, 2005. <br /> <br />Mayor Adams opened the public hearing at 7:06 p.m. <br /> <br /> <br />
