Session 1726, Minutes
June 29, 1998

9

times and has hired his own appraiser. The County has accepted his appraiser's
evaluation over their own. He believes front footage should be the only basis for this
project.

Mr. George Dunn, #1 or 600 Yale, said that he just moved into the home, which he
recently inherited, and he does not mind paying his portion of the bill to bring the streets
back up to shape. He does not remember any mention about improvements to the
sidewalks. He would like to know what will be done about the sidewalks, which are in
terrible shape. He said that, secondly, everyone that goes to Lewis Park parks in front
of his house and he has a problem with this. Mayor Adams said that the City is not
enforcing the residents to go through with the project. The residents asked the City to
be the conduit for them to do this project. Mr. Dunn said he understands, but he still
wants the issue of the sidewalks addressed. Mayor Adams said that this question
should be directed to the subdivision trustees.

Mr. Schoomer said that Mr. Ron Scott, a trustee is in the audience and asked Mr. Scott
if he would address this problem.

Mr. Ollendorff said that the decision was made several months ago by the trustees and
a committee of residents to limit the improvements to curbs and the street surface. The
sidewalks were to be handled at a future date.

Mr. Dunn asked who would be liable if someone were to hurt themselves as a result of
the poor sidewalks. Mr. Ollendorff replied that whomever was sued would be liable.

Mr. Ron Scott, 6942 Amherst, Trustee, said that the trustees were responsible for the
sidewalk repair. They are working on a plan to get the sidewalks repaired. They know
that a number of them are in disrepair and are dangerous. He cannot say exactly when
it will be done, depending on how well things go with the neighborhood improvement
district. Mr. Scott invited Mr. Dunn to speak with him further about his concerns.

Ms. Sheila Bee, 6900 Cornell, said that they live opposite to some City buildings which
bring in a lot of public parking and she wondered if the City would be billed for the
improvements since they are parking on the road. Mr. OIlendorff said that the City Hall
property does pay the annual fees to the subdivision, but they are not included in the
improvement district, because the streets adjacent to City Hall are not included. The
City pays to take care of the curbs and pavement in front of City Hall.

Mr. Schoomer said that the school district and municipal authority are specifically
exempt from the district by state law. The City has, for approximately fifteen years,
painted and paved those sections of Trinity and a couple of drives on Trinity and
Princeton at the City's expense. Ms. Bee asked if that meant the portions of Trinity will
