ORDINANCE NO. <br />AN ORDINANCE AMENDING CHAPTER 8.12 OF THE UNIVERSITY CITY <br />MUNICIPAL CODE, RELATING TO SOLID WASTE MANAGEMENT DISPOSAL, <br />BY REPEALING SECTION 8.12.120 THEREOF, RELATING TO THE <br />REPLACEMENT OF SOLID WASTE CONTAINERS , AND ENACTING IN LIEU <br />THEREOF A NEW SECTION TO BE KNOWN AS “8.12.120 TYPES OF SOLID <br />WASTE CONTAINERS-REPLACEMENT”; THEREBY AMENDING SAID SECTION <br />SO AS TO AUTHORIZE THE DIRECTOR OF FINANCE TO ESTABLISH SOLID <br />WASTE CONTAINER RENTAL FEES AS NEEDED TO PROVIDE RESIDENTS <br />APPROPRIATE CARTS AND DUMPSTERS; AND, TO INCREASE SOLID WASTE <br />FEES; CONTAINING A SAVINGS CLAUSE AND PROVIDING A PENALTY <br />WHEREAS, the services provided by the City to its residents for the collection and disposal <br />of solid waste and for the administration of the City’s solid waste management program exceeds the <br />cost of such services; and <br />WHEREAS, the City Council desires to increase the fees for solid waste management <br />services as provided herein; and <br />WHEREAS,the fee increases reflected in this ordinance are designed and intended to recoup <br />the City’s costs for the provision of these services, and the City Council finds and determines that the <br />increases provided for herein are reasonable and necessary for such recoupment and reflect the actual <br />value of the services so rendered; and <br />WHEREAS, the City Council desires to provide appropriate solid waste carts and dumpsters <br />to residents without them incurring a substantial fee at the time of replacement; <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, <br />MISSOURI, AS FOLLOWS: <br />Section 1. Chapter 8.12 of the University City Municipal Code, relating to solid waste <br />management and disposal, is hereby amended by repealing Section 8.12.120 thereof, relating to types <br />of solid waste containers – replacement, and enacting in lieu thereof a new section to be known as <br />“Section 8.12.120 Types of solid waste containers – replacement”, so that said section, as so <br />amended, shall read as follows: <br />8.12.120 Types of solid waste containers – replacement. <br />A.One to Two Family Residential Buildings. For one and two family buildings, roll-out <br />plastic carts shall be provided for said waste storage and collections, except where collections are <br />from the alley. Carts shall have a capacity of either sixty (60) or ninety (90) gallons or other size as <br />designated by the director of public works. The use of sixty (60) gallon carts shall be limited to units <br />occupied by no more than two persons, one of whom is at least sixty five (65) years of age. Carts <br />shall have wheels, handles, and a hinged, tight-fitting lid capable of containing solid waste and <br />reducing odors, and shall be compatible with existing city equipment for mechanical lifting and <br />dumping. Carts shall weigh, with contents when full, not in excess of two hundred (200) pounds. <br /> <br />
