DRAFT <br />Mechanical box-type containers shall be used for alley collections or where permitted by the director <br />of public works. <br />B.Three to Four Family Residential and Non-Residential Buildings. For three-family <br />and four-family residential buildings, and for non-residential buildings, solid waste shall be stored in <br />a mechanical box-type container or containers. Mechanical box-type containers shall (1) have a <br />capacity of one and one-half cubic yards or greater, (2) have a hinged, tight-fitting lid capable of <br />containing solid waste and reducing odors, and (3) be equipped with lugs and brackets, permitting <br />city sanitation trucks or private contract haulers to mechanically pick up and remove the content. <br />Roll-out plastic carts may be used for three-family and four-family residential buildings where <br />permitted by the director of public works. <br />C.Public solid waste containers may be placed in public places, and the placement of, <br />and collection of solid waste from said containers shall be as authorized by the director of public <br />works. Public solid waste containers placed on city sidewalks, streets, parks and other public places <br />shall be used only for such solid waste as persons may have for disposal while passing along the <br />streets or using the city’s parks or other public places. Such containers shall not be used for the <br />disposal of solid waste accumulated in residences or places of business. <br />D.The director of finance shall establish and charge owners a reasonable rental fee for <br />replacing roll-out plastic carts, recyclables containers and dumpsters. Funds received for this <br />purpose will be used only for the purpose of replacing said carts, containers and dumpsters. <br />Section 2. The collection fees established in the attached Exhibit A, incorporated by <br />reference, are hereby ratified, established, and imposed as authorized by Section 8.12.200.A of the <br />Municipal Code to cover the cost of providing solid waste managementservices. <br />Section 3. This ordinance shall not be construed so as to reeve any person, firm or <br />corporation from any penalty heretofore incurred by the violation of Chapter 8.12, Section 8.12.120, <br />nor bar the prosecution of any such violation. <br />Section 4. Any person, firm or corporation violating any of the provisions of this ordnance <br />shall, upon conviction thereof, be subject to the penalty provided in Chapter 1.12, Section 1.12.010 <br />of the University City Municipal Code. <br />.
