Regular meeting <br />August 8, 2005 <br /> <br />a conditional use concerning the odor. Mr. Ollendorff said that Seafood Restaurant was <br />in business before such conditions were placed on businesses. When complaints are <br />received; we would try to get compliance. The way it is right now, it is not as easy to <br />control. If the Council passed it with adoption of specific conditions, it would give us <br />additional teeth. Ms. Colquitt asked if we had a copy of the site approval when they <br />took over as Seafood Restaurant. Mr. Ollendorff said he did not. Ms. Colquitt <br />requested to be able to see it, as she thought that condition was in it. <br /> <br />Ms. Brot asked for clarification of order of handling of the rezoning and/ or the Site Plan. <br /> <br />Mayor Adams asked the Council if they would accept the City Manager’s suggestion of <br />either coming back to Agenda Item #2, depending on what is voted on with the <br />rezoning. This was agreeable with Council. <br /> <br /> <br />AGENDA # 4 – Surplus Real Estate at 1303 Midland Drive <br /> <br />Request is made for authorization to advertise for sale a quarter-acre vacant lot on the <br />corner of Midland Boulevard at Midland Drive, since neighborhood residents no longer <br />wish to maintain it and there was no public need for it. Sale would contribute to our tax <br />base, avoid future maintenance cost and reduce liability. Zoning limited use to one <br />single-family house. The Council will act on any offers received. <br /> <br />Mr. Wagner asked if a single family house could be built on the triangular lot. Mr. <br />Ollendorff said it consisted of about a quarter of an acre, which normally would be big <br />enough for two or three lots but because of its shape, it is really only big enough for one <br />house. <br /> <br />Ms. Colquitt made a motion to approve, and Mr. Wagner seconded the motion. <br /> <br />Mayor Adams asked Mr. Ollendorff to be reassured that it was zoned for single family <br />only. Mr. Ollendorff concurred. <br /> <br />Ms. Brot thanked the City Manager for the excellent material he provided the Council, <br />enabling them to make an informed decision. <br /> <br />Ms. Colquitt was under the impression that U City In Bloom maintained the flowers <br />located on this piece of land. Mr. Ollendorff said that the neighbors have been <br />maintaining the entire lot, but could have made a deal with U-City In Bloom to plant and <br />maintain a flower bed there. The corner where the bed of flowers is located could be <br />left out of the sale, if the Council so wished. <br /> <br />Ms. Colquitt made a motion to accept and was seconded by Mr. Sharpe. <br /> <br />Page 7 <br /> <br />
