BILL 9045 <br />– An ordinance approving a settlement agreement with AT&T/SBC <br /> <br />Landline <br /> <br />CITIZEN COMMENTS <br />Anne Marie Kiddon, 7348 Wellington Ave. <br />Ms. Kiddon asked for verification that the bill Council is approving is the one that <br /> <br />does not allocate any money to the St. Louis County Municipal League. Mayor <br />said the bill being introduced does not allocate any money to St. Louis Municipal <br />League. <br /> <br />Jan Adams, 7150 Cambridge Ave. <br /> <br />Ms. Adams stated that from experience she has had as a class action attorney, <br />she had drafted her comments and asked that they be passed out to the Council <br />follow. She stated “It is the duty of the University City Council to recover all tax <br />revenue withheld by AT&T. Every dollar of the Class Settlement that goes to <br />attorneys is a percentage less that is recovered by the City. The Courts <br /> <br />determine the fairness of attorney fees in class actions.” Ms. Adams stated that <br />this Council is compelled to seek an independent legal opinion on whether or <br />not the Council should ask the court to have a Fairness Hearing on the attorney <br />fees. This has to be filed by August 31. She stated the court anticipates a fight <br />over attorney fees and specifically states that the payments made to the <br />municipalities set out in this settlement will not be delayed over any dispute over <br />the Fairness of these attorneys’ fees. If the court reduces the attorneys’ fees <br />the City will receive a proportionately greater award. Ms. Adams believes the <br />mandate by the City Charter to the City Council is to recover the maximum <br />amount of tax revenue that was withheld by AT&T. <br /> <br /> <br /> <br />
