BILL 9041 <br />- An ordinance amending Chapter 8.12 of the University City <br />Municipal Code, relating to solid waste management disposal, by establishing <br />and imposing fees for solid waste collection services, effective September 1, <br />2009. <br /> <br />CITIZEN COMMENTS <br />Anne Marie Kiddon, 7348 Wellington <br />Ms. Kiddon stated she had previously asked for the specific numbers in the <br />increase in recycling and the decrease in number of the land-fill charges, but has <br />not received them yet. She would like to know these numbers. Ms. Kiddon <br />asked the Director of Public Work Ms. Evelyn Benford-Shields to what extent has <br />the City sought in working with surrounding communities, as in applying for trash <br />containers the County was offering or combining with other municipalities for <br />purchasing. She asked if the City has tried everything by way of saving costs <br />before the City asked for additional money. She asked if the money the City is <br />asking for in additional taxation is going into the General Fund. She asked a <br />Councilmember to be sure she receives an answer to her questions, as she <br />stated this was her third request. <br /> <br />Mr. Price stated that if she would send the information to the City Manger, she <br /> <br />can send the answers back to him and he will get the answers to her. He stated <br />that the City has not done enough yet on recycling, as everyone is not recycling. <br />He stated that the Director of Public Works Ms. Benford-Shields said that for a <br />thirty percent increase in recycling the City could save $400,000 is disposal fees. <br /> <br /> <br />Mr. Wagner moved for approval and was seconded by Mr. Crow. <br />Roll Call Vote was: <br />AYES: Mr. Price, Ms. Ricci, Mr. Wagner, Mr. Crow, Mr. Sharpe, and Mayor <br />Adams. <br />NAYS: none <br /> <br />Bill 9041 became Ordinance 6787 <br /> <br />BILL 9042 <br />- An odinance amending Chapter 8.12 of the University City <br />Municipal Code, relating to solid waste management and disposal, by repealing <br />Section 8.12.120 thereof, relating to types of solid waste containers - <br /> <br />replacement, and enacting in lieu thereof a new section to be known as “Section <br />8.12.120 types of solid waste containers - replacement”; thereby amending said <br />section so as to authorize the Director of Finance to establish, impose and <br />assess a fee that reflects the total cost of replacing solid waste containers; <br />containing a savings clause and providing a penalty <br /> <br /> <br />CITIZEN COMMENTS <br />Stephen Kraft, 7275 Creveling Dr. <br />Mr. Kraft said that Bill No. 9042, states “the Director of Finance is to establish, <br />impose and assess a fee that reflects the total cost of replacing solid waste <br />containers" violates the Missouri Constitution, Article 10, Section 22, “Counties <br />and other political subdivisions are hereby prohibited from levying any tax, <br />license or fees, not authorized by law, charter or self-enforcing provisions of the <br />constitution when this section is adopted or from increasing the current levy of an <br />existing tax, license or fees, above that current levy authorized by law or charter <br />when this section is adopted without the approval of the required majority of the <br /> <br /> <br />
