She said residents are not opposed <br />to development, only this particular type of development and this developer. <br /> <br />Mr. Schoomer said the proposal meets all Code requirements and is in conformity with the Comprehen- <br />sive Plan. If denied, the developer would be deprived of his rights in developing property he has owned <br />for some years. Responding to Mr. Lieberman, Mr. Ollendorff'said all legal requirements have been met. <br /> <br />Mr. Wagner commended Mr. Londe and Mr. Sauer for scaling down their proposal; however, he was <br />still disappointed about several points--there are less than two parking spaces per apartment and the off- <br />street passenger loading/unloading and offstreet delivery vehicle parking are not fully provided for. He <br />was also disappointed that Mr. Londe and Mr. Sauer have not made themselves available to residents. <br /> <br />Mr. Wagner called for a roll call, which was as follows: AYES: Councilmembers Ware, Munkel, Lieber- <br />man, Schoomer, and Mayor Adams. NAYS: Councilmembers Wagner and Thompson. The motion <br />carded by a xtote of five to two. <br /> <br />SITE PLAN - 7014 PERSHING/COFFEE HOUSE <br /> <br />The City Manager recommended denial of the site plan for a coffee house at 7014 Pershing since previ- <br />ous food service establishments in this commercial area have led to nuisance and parking problems for <br />the surrounding residential neighborhood. If Council contemplates approval, conditions should include <br />limitations on hours, employee parking, outside activity, and a clear statement that no liquor license will <br />be given. In addition, residents have previously asked that they be given an opportunity to comment <br />should Council consider approving a food service of any type. <br /> <br />Mr. Schoomer moved approval, and Mr. Wagner seconded. <br /> <br />The applicant, Mr. Patrick Liberto, 11015 West Port Station Drive, said he had looked at this location <br />carefully and agreed it was not a proper site for a sports bar/restaurant like the one which caused so <br />much difficulty several years ago. However, he does have concern for the neighborhood since he would <br />like to be accepted. He said foot traffic is important here as well as having a university adjacent to the <br />site. Also, his business would not compete with but would complement those already there. He said <br />he had no intention of applying for a liquor license. He also spoke with several of the neighbors and <br />listened to their concerns, and has changed the closing time from 3 a.m. to 11 p.m. He had no objection <br />to notifying neighbors and hearing their comments at a subsequent meeting. <br /> <br />In response to Mr. Lieberman, Mr. Ollendorffsaid there are not enough parking spaces on the lot to ac- <br />commodate a high-volume business. If there were only walk-in customers, it would not be a problem. <br /> <br />Mr. Schoomer said the site was saturated and it was up to the property owner to find a tenant with much <br />lower impact than a food service facility. <br /> <br /> <br />
