Session 1670, Minutes <br />June 24, 1996 <br /> <br />Page 7 <br /> <br />Mr. Schoomer commended Mr. Aboussie and his associates for the diligence with which they have at- <br />tempted to meet the objections of both citizenry and administration. He also expressed admiration for <br />Mr. Spizman, who is trying to find a satisfactory use for this difficult property; however, he felt the <br />proposals made to limit density are not enforceable, and permitting this development would negatively <br />impact the neighborhood, City, and city plan. He said the Code enjoins the Council from granting a <br />variance which will adversely affect the rights of the adjacent property owners, and as he felt this would <br />happen, he moved denial. Mr. Lieberman seconded the motion. <br /> <br />Mrs. Thompson said she has been concerned about Olive Boulevard for many years and felt the pro- <br />posed project might solve some of the problems there; however, after listening to the residents, she <br />realized they had some legitimate concems. She was very sony that something could not be worked out. <br /> <br />All voted Aye. Mayor Adams thanked all concerned for their patience and forbearance on this matter. <br /> <br />CONDITIONAL USE AMENDMENT - 6300 DELMAR <br /> <br />The City Manager said Loop Automotive, 6300 Delmar, wishes to expand the auto repair use in this re- <br />tail commercial pedestrian oriented neighborhood. Mr. Ollendorff concurred in the Plan Commission <br />and staff recommendation to deny this request since the proposed expansion does not meet standards <br />for conditional use approval. Specifically, at this location automobile service use works against the retail <br />commercial character of the Loop; injury is caused to neighboring properties by inhibiting the pedestrian <br />retail character; the proposal does not meet the requirement of being in compliance with the overall <br />neighborhood development plan, including existing Zoning district provisions and the City's comprehen- <br />sive plan, which directs that incompatible and inappropriate uses be excluded, and stronger pedestrian <br />oriented retail and restaurant uses be encouraged. In short, the proposed use is incompatible with the <br />surrounding area. <br /> <br />Mr. Richard Byrd, 7801 Forsyth, attorney representing Loop Automotive, said although he realized <br />Council does not like the way this business looks, that is not the issue. What Council must decide is <br />whether the business should remain as it is now, or if it should be greatly improved as shown in the <br />drawings he presented. He said there have been automotive uses on this site since 1916, so the owner, <br />Mr. Feygelman, will not be leaving any time soon. Mr. Byrd said the proposed changes will be a great <br />asset to University City compared to what is there now. He said the new facility will not increase traffic <br />in the area nor require any new city services. <br /> <br />Mr. Samuel Berger, said he and his partners just bought 6255 and 6263 Delmar (across the street from <br />Loop Automotive) and plan to demolish these two buildings and put in about 20,000 feet of retail space. <br />They are opposed to the expansion of Loop Automotive because it is an eyesore. Mr. Berger suggested <br />that making threats of the kind made by Mr. Byrd are non-productive. <br /> <br />Mr. Schoomer moved to take this item off the table. Mr. Wagner seconded, and all voted Aye. <br /> <br /> <br />
