Session 1670, Minutes <br />June 24, 1996 <br /> <br />Page 8 <br /> <br />Mr. Wagner said he agreed with Mr. Byrd's presentation, and commended Mr. Feygelman for his spirit <br />in trying to improve his business. <br /> <br />Mr. Schoomer said Loop Automotive was a non-conforming use and pointed out the Circuit Court did <br />not say it was; they simply did not rule on it. He said the use was not in accord with the specific plan <br />for the Loop nor the City's comprehensive plan, and it does not enhance the neighborhood in any way. <br />The success of this business should not be at a cost to the neighborhood. He noted the applicant has <br />twice been before the Plan Commission and Council and stated he would abide by the conditions set for <br />the number of vehicles allowed on the site; however, he has failed repeatedly to meet this obligation. <br />He said making this business bigger will not serve the City in any way, and he moved denial. Mr. <br />Lieberrnan seconded the motion. <br /> <br />In response to Mr. Lieberman, Mr. Ollendorffsaid the conditional use has been in effect with the present <br />owner for about five years, and three years before that with a different owner. He said the conditions <br />have not been met by this or the previous owner, with one of the main problems being overnight parking <br />by unlicensed/uninspected vehicles. Also, required landscaping was not done. Mr. Ollendorff said the <br />recommendation to deny is based on incompatibility with the neighborhood. <br /> <br />All voted Aye to deny, except Councilmembers Thompson and Wagner, who voted Nay. <br /> <br />DELMAR PARKING GARAGE BIDS <br /> <br />The City Manager said bids for this project were received Friday, June 21, as follows: <br /> <br />SM Wilson <br />Kloster Company <br />Tarlton Corporation <br />Sverdrup Facilities <br />Orf Construction <br /> <br />$1,949,500 <br />$2,118,000 <br />$2,279,000 <br />$2,288,000 <br />$1,953,000 <br /> <br />The construction budget was approximately $1,600,000. The bids are being analyzed and possible alter- <br />natives studied. Conclusions and a recommendation as to whether to proceed with this project will be <br />reported to Council as soon as all details have been reviewed. Mr. Ollendorff asked that Council take <br />no action on this matter at this time. There was no objection. <br /> <br />POLICE DEPARTMENT REPORT <br /> <br />The Police Department report for the month of May, 1996, was received and ordered filed. <br /> <br />PERSONNEL REPORT <br /> <br />The Personnel report for the week ending June 15, 1996, was received and ordered filed. <br /> <br /> <br />
