3.3.5 Federal Work Authorization Program. <br />Simultaneously with the execution of <br />this Agreement, the Developer shall provide the City with an affidavit and documentation <br />meeting the requirements of Section 285.530, RSMo. <br />3.4 Concept Site Plan.{} <br /> TC \l2 “3.4 Concept Site Plan” <br />3.4.1 Approval of Concept Site Plan. <br />The Concept Site Plan attached hereto as <br />Exhibit C <br />is hereby approved in concept. Such approval does not exempt the Developer from the <br />site plan review process required by the City’s municipal code. <br />3.4.2 Changes. <br /> During the progress of the Work, the Developer may make changes to <br />the Concept Site Plan or any aspect thereof as site conditions or other issues of feasibility may <br />dictate or as may be necessary or desirable, in the sole determination of the Developer, to enhance <br />the economic viability of the Redevelopment Project and as may be in furtherance of the general <br />objectives of the Redevelopment Plan; provided <br />, however, that the Developer may not make any <br />changes to the Concept Site Plan without the advance written consent of the City that are, either <br />individually or in the aggregate, material changes to the Concept Site Plan. For purposes of this <br />Section, material shall mean any change that, in the opinion of the Director of Community <br />Development, does not substantially conform to the Concept Site Plan. The Developer <br />understands that any material changes to the Concept Site Plan that are not approved by the <br />Director of Community Development may not be eligible for reimbursement as provided herein. <br />3.5 Construction Plans.{} <br /> TC \l2 “3.5 Construction Plans.” <br />3.5.1 Standards. <br /> The Construction Plans shall be prepared or approved by a <br />professional engineer or architect licensed to practice in the State of Missouri. The Construction <br />Plans and all construction practices and procedures with respect to the Work shall be in <br />conformity with all applicable state and local laws, ordinances, orders and regulations, including, <br />but not limited to, any performance, labor and material payment bonds required for public <br />improvements. <br />3.5.2 Changes. <br /> During the progress of the Work the Developer may make such <br />reasonable changes as site conditions or orderly development may dictate or as may be necessary <br />or desirable, in the sole determination of the Developer, to enhance the economic viability of the <br />Redevelopment Project and as may be in furtherance of the general objectives of the <br />Redevelopment Plan; provided, that any such change requiring a change to the Concept Site Plan <br />Section 3.4.2 <br />must be made in conformance with the requirements of . <br />3.6 Certification of Substantial Completion. { <br /> TC \l2 “3.6 Certification of Substantial <br />} <br />Completion.” Promptly after substantial completion of the Work in accordance with the provisions of <br />this Agreement, the Developer will furnish to the Inspector a Certificate of Substantial Completion so <br />certifying. The Inspector shall, within 60 days following delivery of the Certificate of Substantial <br />Completion, carry out such inspections as he deems necessary to verify to his reasonable satisfaction the <br />accuracy of the certifications contained in the Certificate of Substantial Completion. The Certificate of <br />Substantial Completion shall be deemed accepted by the Inspector unless, prior to the end of such 60-day <br />period after delivery to the Inspector of the Certificate of Substantial Completion, the Inspector furnishes <br />the Developer with specific written objections to the status of the Work, describing such objections and <br />the measures required to correct such objections in reasonable detail. Upon acceptance of the Certificate <br />of Substantial Completion by the Inspector or upon the lapse of 60 days after delivery thereof to the <br />Inspector without any written objections thereto, the Developer may record the Certificate of Substantial <br />Completion with the St. Louis County Recorder, and the same shall constitute evidence of the satisfaction <br /> <br />
