case regarding the use of eminent
Missouri Municipal League v. Carnahan
The
domain
was argued to the Court of Appeals on December 15. The panel consisted of
Judges White, Hardwick, Smart, and Martin. The case puts a City’s ability to declare
eminent domain/condemnation at risk. At issue are initiatives put forward by the
Missouri Citizens for Property Rights to amend the Missouri Constitution. The intent of
the amendments is to prohibit a person’s home to be condemned for another private
development, such as a shopping center. The League argued that the state ballots
summaries and financial estimates for the initiatives were unfair and insufficient. The
trial court ruled in favor of the League. The following is a link to a media report on the
oral argument: http://www.dolanmedia.com/view.cfm?recID=549702; the summary is
also attached.
January 14: Missouri Homeownership Preservation Summit
The mission of this summit is to bring together elected officials, community leaders,
industry professionals and non-profit housing agency directors and staff to learn about
current foreclosure, fraud and loan performance trends; new consumer protection and
residential lending laws; engage in discussions with policy experts and housing
professionals; and identify promising practices to preserve homeownership.
