Session 1712, Minutes
December 15, 1997

Mr. Wagner moved approval. Mr. Munkel seconded the motion.

Mr. Lieberman said that he understands that this business has been closed for some
time and that the license is expired and asked if these conditions would not require
these owners to have to apply for a brand new license. Mr. Ollendorff said that they
have applied for a new license and they have obtained all the signatures of
neighboring businesses and property owners. It is a new license as far as Council is
concerned, but it is unusual in that there was a similar license here in the past. Mr.
Lieberman asked if they then would not fall under the requirements that we usually
have for restaurants that wish beer and wine, which is going into business for six
months before a license is granted. Mr. OIlendorff said that the Council has typically
waived that requirement when it was a business in the same location, or the same
business reopening. Mr. Lieberman said that he was not concerned with the
operation or the owners, but with the precedent established. Mayor Adams said that
a precedent that had been established, was to approve if the owner or previous
owner had previous experience with liquor, which does not quite fall under the six
month rule.

Mr. Schoomer said that Jn his recollection there was no police calls to this location for
disorderly circumstances and asked Mr. Ollendorff for verification. Mr. Ollendorff
replied that he was correct nor had there been trouble at the other locations owned
by the new owners.

The all-aye motion carried unanimously.

PERSONNEL REPORT

Mayor Adams noted the personnel report ending November 29,1997 and ordered it
filed.

CITY CLERK'S DOCKET:

BILL FOR SECOND AND THIRD READING:

BILL NO. 8358 - GRANTING, SELLING AND CONVEYING TO THE METROPOLITAN
ST.
