Regular meeting <br />March 20, 2006 <br /> <br />AGENDA ITEM #2 – Public Hearing on Rezoning 7384 Forsyth <br /> <br />Applicant has withdrawn but for the record the Public Hearing could be opened but then <br />closed and cancelled. Mayor Adams declared the Public Hearing open at 6:05 p.m.. <br />No one was present to speak so Mayor Adams declared the Public Hearing closed at <br />6:06 p.m. <br /> <br /> <br />AGENDA ITEM #3 – Zoning Public Hearing Cancelled. <br />There was not a need to have a Public Hearing as there was no longer any interest in <br />the project. <br /> <br /> <br />AGENDA ITEM #4 – Alcoholic Beverage License Policy for Restaurants <br />City Council has had a long standing policy of a lengthy period of observation before <br />approving a license to sell alcoholic beverages. Mr. Ollendorff said that in recent years, <br />City Council has made numerous exceptions to this policy, which is not part of the city <br />code requirements. Several businesses have been lost because of their perception that <br />all restaurants would have to wait this period of time before being granted a liquor <br />license. It was recommended to delete the mandatory waiting period from the declared <br />policy statement. It would still leave the total discretion on granting a license to the <br />Council upon review of each application. Ms. Welsch moved for adoption and was <br />seconded by Ms. Brot. <br /> <br />Ms. Colquitt was not in favor of removing the clause. Mr. Ollendorff said that it would <br />only apply to restaurants. <br /> <br />Ms. Welsch would like to see how the new wording would be handled so as not to open <br />us to litigation. <br /> <br />Mr. Sharpe, Jr. asked if it could be reworded, stating that there is the possibility that the <br />six months observation period could be waived. <br /> <br />Ms. Brot agreed and referred it back to Mr. Ollendorff for rewording. Ms. Brot made a <br />motion to defer and was seconded by Ms. Welsch. The motion carried unanimously. <br /> <br /> <br />AGENDA ITEM #5 — Update on Ames Place/Metro Condemnation <br />Update information was included in Council’s material from City Attorney, John <br />Mulligan. Mr. Ollendorff said that the most recent update was that the St. Louis County <br />Circuit Court, Judge Vincent ruled that the “Green Space” property, upon which <br />MetroLink is being built, belongs to Ames Place. He also ruled that University City <br />should be removed from the law suit between Metro and Ames Place. <br /> <br />Page 3 <br /> <br />
