Department of Community Development <br />6801 Delmar Boulevard, University City, Missouri 63130, Phone: (314) 505-8500, Fax: (314) 862-3168 <br />January 28, 2010 <br />Ms. Joyce Pumm, City Clerk RE: Application for Conditional <br />City of University City Use Permit P100023 <br />6801 Delmar Boulevard 6665 Delmar Boulevard <br />University City, MO 63130 <br />Dear Ms. Pumm, <br />At its regular meeting on January 27, 2010 at 6:30 p.m. in the Emergency <br />Operations Center of City Hall, 6801 Delmar Boulevard, the City Plan <br />Commission conducted a hearing on an application by John Huang, representing <br />Ginger Asian Bistro Inc., for a conditional use permit to allow a restaurant on the <br />ground floor of a premises in the CC – Core Commercial District. <br />The Plan Commission recommends approval of the application subject to the <br />following conditions: <br />1. Outdoor dining areas and displays of merchandise shall be prohibited <br />between November 15 and March 15. During this period, all portable <br />furniture and fixtures associated with outdoor dining (on-premises or on <br />public sidewalks) shall be stored within completely enclosed buildings. <br />Outdoor dining shall be arranged in such a way so as not to inhibit the <br />safe movement of pedestrian traffic along public sidewalks. All furniture <br />and fixtures, located on public sidewalks shall be entirely portable. <br />2. Outdoor displays of merchandise shall be permitted only on private <br />property located between the frontage of a ground floor premise and the <br />nearest public right-of-way. <br />3. A sign permit will be required prior to the installation of any signage by the <br />tenant. <br />4. If any landscaping is to be installed, a detailed landscaping plan shall be <br />submitted to the director of planning for approval, in conjunction with a <br />review by the city forester. Landscaping shall be installed and maintained <br />in accordance with the approved plan. <br />5. A liquor license shall be obtained in accordance with the University City <br />Municipal Code prior to the sale of any liquor or operation of the bar. The <br />hours of operation for the bar and the hours in which alcoholic beverages <br />may be sold shall conform to the hours set forth in the liquor license. <br /> <br />
