RECESS Mayor Mooney recessed the meeting at 8:40 p.m. The meeting reconvened at 9:30 p.m. PUBLIC HEARING Mayor Mooney said a public hearing was to be held on Monday, September 20, 1982, at 8:00 p.m. for the purpose of discussing uses of funds for the City's Community De- velopment program. BILL FOR THIRD READING BILL NO. 7542 - AMENDING CHAPTER 18 MUNICIPAL CODE RELATING TO LICENSES AND BUSI- NESS REGULATIONS, BY REPEALING SECTION 18-19, AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS "SECTION 18-19. LISTING OF BUSINESSES HAVING SET FEES; AMOUNTS OF FEES," BY AMENDING SAID SECTION SO AS TO INCREASE THE LICENSE FEE FOR AUTOMATIC COIN-OPERATED MACHINES. Mr. Ollendorff suggested that this bill be withdrawn or defeated because of the re- cent Supreme Court ruling regarding fee changes. Mr. Adams moved that Bill No. 7542 be defeated. Mrs. Metcalfe seconded the motion. Upon roll call, the following vote was recorded: AYES: Councilmembers Adams, Metcalfe, Levy, Schoomer, Thompson and Mayor Mooney. NAYS: Councilmember Lieberman. The motion to defeat carried by a vote of six to one. BILLS FOR SECOND READING BILL NO. 7547 - APPROVING THE PLAT OF THE RESUBDIVISION OF LOT 7, BLOCK A OF BEMIS- TON SUBDIVISION, AT 149 NORTH HANLEY ROAD IN UNIVERSITY CITY, MISSOURI. Bill No. 7547 was given its second reading. Bill No. 7547 was given its third reading. Mr. Levy moved that this bill be adopted as an ordinance. Mrs. Metcalfe seconded the motion. Upon roll call, the following vote was recorded: AYES: Councilmembers Metcalfe, Levy, Schoomer, Thompson, Lieberman, Adams and Mayor Mooney. NAYS: None. Bill No. 7547 became Ordinance No. 5344. BILL NO. 7548 - AMENDING CHAPTER 14 MUNICIPAL CODE RELATING TO GARBAGE, REFUSE AND WEEDS, BY REPEALING SECTION 14-37, AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS "SECTION 14-37. SCHEDULE OF CHARGES," SO AS TO ADJUST THE RATES. Mr. Ollendorff recommended that this bill also be withdrawn or defeated. He said the bill provided for increased refuse rates, but the recent Supreme Court decision mandated that increases in fees of any type must be voted on by the electorate. In place of this bill, he asked that another bill be introduced and approved, which will place the issue of increased refuse rates on the ballot in November, 1982. Mrs. Met- calfe moved that Bill No. 7548 be withdrawn. Mr. Schoomer seconded the motion. All voted Aye except Mr. Adams, who voted Nay. The motion carried by a vote of six to one.
