<br /> <br /> <br /> <br /> Session 1309, Minutes Page 7 <br /> June 7, 1982 <br /> <br /> <br /> Mrs. Ruth Fischlowitz Marget, 7022 Delmar, asked to address the Council. Mrs. Mar- <br /> get said her home was on the alley across from the pool being discussed. She felt <br /> that the zoning laws of the City were being abused by allowing persons other than <br /> family or friends to use a private swimming pool. Despite the compromise offered <br /> by Childgrove, she asked that their petition for temporary use of the pool be denied. <br /> Ms Kim Sindel, 6326 Waterman, asked to address the Council. She said she sympa- <br /> thized with the Council in having to make a very difficult decision; however, as a <br /> governmental body, it must address the immediate situation and weigh the equities of <br /> all the factors. She felt that since Childgrove had made a strong effort, through <br /> offering a compromise, to mitigate as much as possible the effect of the pools <br /> usage on its neighbors and still try to fulfill its obligations to the parents and <br /> children of the camp, she asked that the Council approve the compromise, for this <br /> summer only, as the best and most honest solution to the problem. <br /> Mrs. Roberta Sidel, 7128 Washington, asked to address the Council. She also sympa- <br /> thized with the difficulty of the decision faced by Council. However, she thought <br /> that the term "conditional use" meant spot zoning, and she said neighborhoods in the <br /> City of St. Louis had been permanently changed for the worse through this measure <br /> and she did not wish that to happen in University City. She said she might still <br /> have been inclined to be in favor of the conditional use for just one summer, but <br /> felt that it infringed too much on the neighbor who had a life-threatening illness. <br /> She did not think the Council should consider approval under any circumstances. <br /> Mr. Allen Sabol, 7214 Dartmouth, asked to address the Council. Mr. Sabol urged the <br /> Council to vote in favor of the conditional use permit, with the revised conditions <br /> suggested by Mrs. Gianoulakis. He also suggested that the school be allowed to use <br /> the pool for as many years as they felt they needed it. <br /> Mr. Frank L. Seeger, 7150 Washington, requested that the conditional use permit not <br /> be approved, and that provisions be made for the children to take swimming instruc- <br /> tion at Heman Park pool. <br /> Mrs. Elsie Glickert, 6712 Etzel, noted that she had sent a communication to Council <br /> about this matter, which she would not repeat here; however, she wished to be on <br /> record as emphasizing the importance of zoning, and the thought of a variance in a <br /> conditional use permit frightened her very much. She agreed that Childgrove was a <br /> tremendous community asset but saw no reason why the children could not be taught <br /> at Heman Park pool, as proposed by several other speakers. She said the fact that <br /> a brochure had already been printed was not the problem of the City Council. She <br /> thought the children could be given swimming lessons in the roped-off section of <br /> the pool during the morning before the pool is opened to the public, and the neigh- <br /> borhood in question could be kept quiet and peaceful. She pointed out that the <br /> Council has the authority to permit Childgrove the use of the Heman Park pool. <br /> As liaison to the Plan Commission, Mrs. Metcalfe stated that she thought the Plan <br /> Commission had considered all aspects of this matter very carefully and thoroughly, <br /> realizing, as the chairman stated, that neighborhood relations are a very sensitive <br /> balance of consideration and tolerance. The Commission concluded that the appro- <br /> priate thing to do was to grant permission for one summer camp session only for a <br /> use of the pool which was less than half as intense as the original application <br /> (which was 221~ hours per week, plus free swim).
