<br /> 1 ~ <br /> <br /> <br /> Session 1309, Minutes Page 8 <br /> June 7, 1982 <br /> <br /> <br /> quest for a conditional use permit be granted, with the conditions recommended by <br /> the Plan Commission--1) time period of June 1 to August 30, 1982; 2) swimming per- <br /> mitted three days per week only; 3) in-pool time limited to three hours per day be- <br /> tween 10:00 a.m. and 2:00 p.m.; 4) pool area to be vacated for one hour mid-day; <br /> 5) director of camp must submit to Plan Commission chairman the schedule for the <br /> swimming program prior to the opening of camp June 14, 1982; and 6) a maximum num- <br /> ber of seventeen students permitted in the pool at any one time, and a maximum num- <br /> ber of five adults accompanying them. Mr. Adams seconded the motion. Mrs. Met- <br /> calfe said she felt the Plan Commission did an excellent job in considering this <br /> issue and that she did not feel that the alternate plan, proposed by Mrs. Gianou- <br /> lakis after examing the camp schedule, was a material difference. <br /> Mrs. Thompson asked if it was correct that the Council had the power to allow the <br /> Childgrove summer camp to use the pool at Heman Park, and the Mayor said that was <br /> correct. Mrs. Metcalfe responded that it was brought out at the Plan Commission <br /> meeting that the City's swimming program as taught at Heman Park was totally dif- <br /> ferent from the program that has been taught at this camp. <br /> Mr. Adams said he was not sure the Council had the power to issue a conditional use <br /> permit where they tell a family how they may use their own swimming pool, and that <br /> no one except immediate family members may be invited to use the pool. He noted <br /> that the Gianoulakises will not receive compensation for use of their pool. He <br /> said excessive noise would be a police matter. Mr. Adams moved to amend Mrs. Met- <br /> calfe's motion by accepting the alternative plan proposed by Mrs. Gianoulakis, with <br /> the following conditions: <br /> 1) The time period to be June 14 to August 6, 1982. <br /> 2) Swimming to be permitted four days a week, Monday through Thursday. <br /> 3) In-pool time to be limited to two and one-half (21~) hours per day be- <br /> tween 10:00 a.m. and 1:45 p.m. <br /> 4) The pool to be vacated for forty-five (45) minutes mid-day, as per <br /> attached schedule. <br /> 5) Prior to June 14 camp opening, director to submit to Plan Commission <br /> chairman the schedule for the swimming program. <br /> 6) Maximum of seventeen (17) students and five (5) adults in pool at <br /> any one time. <br /> Mr. Schoomer seconded the motion. <br /> Mr. Levy said it disturbed him that this issue has reached such an emotional inten- <br /> sity with it becoming personalized between neighbors. He said each viewpoint had <br /> merit, although he felt a number of irrelevancies had been injected into the matter. <br /> He thought it was the Council's obligation to try to focus as objectively as possi- <br /> ble on what it has control over, and that was the intent and focus of its concern <br /> about zoning and about ordinances. Many speakers had noted how important it was to <br /> adhere to strict enforcement of zoning laws in order to protect the integrity of <br /> the City's residential areas, but the real issue was one of noise and disturbance <br /> for a University City citizen, and whether it was one or many, it did not alter the <br /> integrity of the complaint. It was not handled privately and therefore, it's the <br /> Council's problem to solve. Mr. Levy said the fact that Childgrove had already <br /> formulated its summer plans was a valid issue and could not be ignored. He said he <br /> would like to see the Council accommodate this extenuating circumstance but in some <br />
