Ms. Miller said she hoped that none of Council took it personally as she has <br />the right to come up to the podium and say whatever she feels like saying without being eye- <br />balled and talked about while she is up there making comments. Ms. Miller has also found out <br />that Ms. Nickerson has been inappropriately removed from the Retail Sales Tax Commission <br />without the appropriate process being followed. She stated that since Mayor Welsch has taken <br />office there has been a consistent disregard for following process and procedures. Ms. Miller <br />wanted to know if there is going to be some reconciliation or are they just going to run <br />University City into the ground. <br /> <br />Ms. Paulette Carr, 7901 Gannon <br />Ms. Carr stated that Mayor Welsch surreptitiously removed a member of the Economic Sales <br />Tax Board, Gloria Nickerson without the knowledge of at least three of the Councilmembers. <br />Mayor Adams nominated Ms. Nickerson on April 12, 2010. There was a controversy regarding <br />the nomination because the nominations were not on the agenda at least twenty-four hours <br />prior to the meeting. That is a violation of the Sunshine Law. In spite of this violation, Ms. <br />Nickerson was appointed with the consent of the majority of the Council and sworn in. She <br />said that Janet Watson, the Interim City Manager had repeatedly asked for Ms. Nickerson <br />resignation. Mayor Welsch had a meeting with Ms. Nickerson and she had agreed to resign but <br />rescinded that permission the next day. Mr. Walker also talked to Ms. Nickerson concerning <br />her resignation. Ms. Nickerson sought legal advice and a letter was sent to Mayor Welsch to <br />cease and desist and if she thought it was a Sunshine violation to bring up at the County Court. <br />Ms. Carr noted that meetings of the Economic Sales Tax Board were suspended after May 20, <br />2010. Ms. Nickerson received a letter on January 18, 2011 informing her that on January 10, <br />2011, Gordon Myers had been reappointed to his position and City Attorney John Mulligan had <br />reviewed her status and concluded that her appointment was in violation of the Sunshine Law. <br />She asked who authorized the removal of Ms. Nickerson. Ms. Carr stated that our form of <br />government is Council Manager not Mayor Council Manager Government. She was concerned <br />that Mayor is imposing a defacto alteration in our form of government by not informing <br />Councilmembers. <br /> <br />I. PUBLIC HEARINGS <br /> <br />J. CITY MANAGER’S REPORT <br />1. <br />Olive Boulevard Streetscape Improvements – Phase III Construction. <br />City Manager recommended award to the lowest bidder Concrete Design, Inc. for <br />$834,108.86, the federal share, $658,946 and the City share, $175,162.86. The <br />improvements include energy saving modifications to existing light fixtures, installation of <br />schedule holders at four existing bus shelters, removal and replacement of asphalt paved <br />shoulders with concrete and sidewalks with ADA compliant ramps between Eastover Ave <br />and Pennsylvania Ave. <br /> <br />Mr. Glickert moved to approve and was seconded by Mr.Sharpe. <br /> <br />Mr. Price wanted to verify that this is Phase III of Olive but noted he cannot tell it is improved <br />as Olive looks the same.
