Mr. Sharpe seconded the <br />motion, which carried unanimously. <br /> <br />AGENDA #2: PUBLIC HEARING - REQUEST FOR CABLE TELEVISION <br />FRANCHISE TRANSFER: <br /> <br />Mr. Ollendorff said that a public hearing for this time and place has been set by the City <br />Council to hear any comments on the proposed transfer of our cable television <br />franchise. No action is being suggested this evening. <br /> <br />Mayor Adams opened the public hearing at 7:35 p.m. Being that there were no <br />requests to speak the public hearing was closed at 7:36 p.m. <br /> <br />Mr. Wagner asked if the CALOP provision was protected with this impending transfer. <br />Mr. Ollendorff said that CALOP would not be affected by the transfer and would stay in <br />place. The issue will come up when the Council is asked to approve the renewal of the <br />franchise. Mr. Wagner wanted to make sure, for the record, that this should be revisited <br />in the future and that support of CALOP is very valuable to the City. <br /> <br />Mr. Ollendorff asked Mr. Gregory Rose, Assistant City Manager, to clarify the bill <br />preparation for the transfer. <br /> <br />Mr. Gregory Rose, Assistant City Manager, stated that the City received a request to <br />transfer the franchise agreement to AT&T on September 10, 1998. For the past two <br />months, he has been working with Mr. Ken Hines, the City's special counsel for cable <br />matters, on this issue. The City Council has until January 7, 1999 to consider the <br />transfer. If Council has not acted on the request by January 7, 1999, the FCC will <br />deem that the Council has approved the transfer. The proposed ordinance that has <br />been presented has a number of policy issues that Council should consider. Some of <br />the concerns include, proposed ordinance transfers existing franchise agreement from <br />TCI to AT&T, if AT&T agrees to guarantee the performance of all obligations of the <br />franchise, including constructing an institutional network, and an emergency alert <br />override system. It also requires that AT&T become a signatory on the franchise. The <br />proposed ordinance also extends the existing franchise agreement to the year June 23, <br /> <br /> <br />
