<br />Minutes from the 5/20/92 Board of Adjustment Meeting Page 2 <br /> <br />CASE #2330 - FRONT AND REAR YARD V ARIANCES TO PERMIT THE <br />CONSTRUCTION OF A BUILDING ADDITION AT 725 SW ARTHMORE, DENNIS <br />TACCHI REPRESENTING SIDNEY AND KATHY MACHEFSKY <br /> <br />Mr. Tacchi requested a variance of ~~ 34-30.3(b) and (d) to permit the construction of a <br />building addition that will encroach into both the required front yard and rear yard. The hearing <br />was tabled until the next meeting by a vote of 5 - 0 to allow the applicant to provide information <br />regarding: <br />1. The proximity of the mass of the proposed structure to Swarthmore. <br />2. The total building mass proposed and the form of the structure proposed. <br />3. Landscaping to be executed as a part of the proposed project. <br /> <br />CASE #2331 - APPEAL ZONING ADMINISTRATOR'S DECISION THAT THE ROOF <br />STRUCTURE BUILT IN THE SIDE YARD OF 7334 CANTON VIOLATES SIDE YARD <br />REQUIREMENTS AND IN THE ALTERNATIVE A VARIANCE TO PERMIT SAID <br />STRUCTURE, MICHAEL CORN REPRESENTING RICHARD AND ELIZABETH BYRD <br /> <br />The applicant stated that the structure in question was a canopy and thus was exempt from yard <br />requirements in accordance with the exception listed in ~34-24.4. He further stated that affected <br />neighbors do not object to the presence of the structure and that its presence was not in any way <br />detrimental. Mr. Goldman testified that it was not the intent of the code to allow roof structures <br />such as carports or patio shelters in side or front yards, that such structures were not "canopies" <br />and that such an interpretation would make it possible to roof over an entire lot. The appeal of <br />the Zoning Administrator's decision was denied by a vote of 5 - 0, thereby requiring the removal <br />of the roof structure from the required side yard. The variance was denied by a vote of 3 - 2. <br /> <br />CASE #2322 - MODIFICATION OF SITE PLAN FOR PREVIOUSLY APPROVED REAR <br />YARD VARIANCE TO PERMIT THE CONSTRUCTION OF A BUILDING ADDITION <br />AT 7752 BURR OAK, DONALD MILLS REPRESENTED BY S & G BUILDERS <br /> <br />Mr. Goldman stated that subsequent to the March 18, 1992 Board decision to grant rear yard <br />variance for 7752 Burr Oak, a building permit application was filed for a building addition that <br />is 2 1/2' wider than the one reviewed by the Board when it was granted a variance. He explained <br />that the rear yard dimension of 26' approved by the Board will remain unchanged, but the Board <br />should have the opportunity to review the revised plan. The revised site plan modification was <br />granted by a vote of 5 - O. <br />
