<br />Minimum Requirements for Code Appeals <br /> <br />This information describes the process for submitting a Code Appeal. <br /> <br /> <br /> What is aCode Appeal <br />1) ? <br />A code appeal is the act of challenging the decisions made by the Code Official as <br />it relates to the interpretation of the Building Codes or the Adopting Ordinances. <br />An application for appeal must clearly demonstrate that the intent of the Building <br />Codes or Adopting Ordinances has been either one of the following: <br /> a) Misinterpreted <br /> b) Does not apply <br /> c) Replaced by a better method of construction <br /> <br />It should be understood that the board has no authority to waive the requirements of <br />the Building Codes or Adopting Ordinances. <br />* <br />Before an appeal is heard by the board, it will be reviewed by the code official to <br />determine whether or not a valid argument of misinterpretation, incorrect application, <br />or alternative construction has been presented. <br /> <br /> Forms to complete for submission: <br />2) <br /> <br />a)Application form <br /> <br />b)A statement that describes the scope of work and the proposed appeal. <br />Describe the applicable code section that applies (or doesn’t) to the work. <br /> <br />c)Present additional information regarding the effects of the code on similar <br />or surrounding properties. <br /> <br />d)At the applicant’s discretion, letters supporting the claims of the appeal <br />may be submitted.
