He believes it granted a use permit to the owner on the west for a retail store <br />to occupy the first: floor, which required a permanent easement be granted. Mr. Schoomer <br />would like to see that this is resolved and recognized by the owner of this property. <br /> <br />Mr. Wagner said that he was concerned by any late night noise. He requested that a <br />condition be added which states that there be no loading or unloading no later than 9 p.m. <br />each night. Mr. Sharpe agreed. <br /> <br />Mr. Munkel said his concern was that the City has had considerable problems with the <br />Missouri Council for the Blind store across the street. There are safeguards in the form of <br />the conditional use permit, but he is sure many of the same conditions were put on the use <br />permit for the Missouri Council for the Blind facility, as well to no avail. Mr. Munkel asked <br />how the city would plan to police this, and secondly, if the city could afford two non-for- <br />profits in this area. Mr. Lieberman believes these are concerns that should be thought <br />about. The tax issues are very important. He would very much like to see that building <br />occupied and the area cleaned up and/or repaired, but the city needs to get something out <br />of it. <br /> <br />Mr. Schoomer said that the Council did not have any alternative of turning it down. It is a <br />lawful occupation. If they meet the conditions set, then Council can not say no. <br /> <br />Mr. Ollendorff wished to respond to some of Mr. Munkel's earlier concerns regarding the <br />illegal drop off problem at the Council of the Blind facility. This was discussed with staff <br />and the. most positive means of policing would be to put up a barricade and chains around <br />the entire property. They rejected it, because it would mean the parking could not be <br />utilized by others. The drop off area is to be closed and screened and appropriate signage <br />will be put up. The owner volunteered to come by and pick up illegally dumped donations <br />at night. He is not positive that there is anything further that can be done that would not <br />hurt the next door business that wants to park on the property. <br /> <br />Mr. Lieberman believes that Mr. Schoomer's statement is correct, but he thought that the <br />Council would have more discretion with allowing or not allowing non-for-profit businesses, <br />since a number of them could potentially create revenue problems for a city. Mr. <br />Lieberman suggested that Council might want to consider postponing this issue until Mr. <br />Ollendorff is able to research it more. <br /> <br />Mayor Adams said that since this is a leased property, the property taxes would still be paid <br />by the owner, Magna Bank - not by Goodwill Industries. <br /> <br />5 <br /> <br /> <br />
