Session 1747 <br />February 22, 1999 <br /> <br />A sight-proof fence shall be erected and maintained along the north property line <br />within sixty (60) days of approval of this permit. <br />A detailed landscaping plan for the rear buffer area and the parking lot island shall <br />be submitted to the Director of Planning for review and approval. Said landscaping <br />shall be installed within ninety (90) days of approval of this permit and shall be <br />maintained in accordance with the approved plan. <br />The donation drop-off area shall be screened from view from the street at all times <br />the resale shop is in operation. Employees shall be available for collection of <br />donations at all times the store is open. A truck shall be dispatched nightly, seven <br />days per week, to collect any donations made after hours. There shall be no loading <br />or unloading after 9:00 p.m. Signs shall be installed prohibiting after-hour donation <br />drop-off. <br /> <br />Responding to Mr. Munkel, Mr. Wagner and Mr. Lieberman both confirmed that the <br />business hours would be 9 a.m. to 7 p.m., Monday through Saturday; Sunday 12 to 5. <br /> <br />Mr. Schoomer asked if the nightly clean up would include weekend nights. Mr. Ollendorff <br />said that this was his understanding, but he was not certain. Mr. Schoomer said that the <br />city's experience with similar institutions is that the donors end up being very sloppy, <br />which becomes a detriment to everyone. Mr. Schoomer asked that it be added as a <br />condition that the store must pickup donations seven nights a week. This is his major <br />concern. <br /> <br />Mr. Lieberman asked who owned the parking lot and if Goodwill owned any of it. Mr. <br />Ollendorff responded that it was not stated in the zoning administrator's report who owned <br />the parking lot. Mr. Ollendorff directed Council to the permit application, where it states <br />that Goodwill Industries is committed to a ten year lease at this location. The owner is <br />listed as Magna Bank. Mr. Lieberman said the reason why he is asking is because they <br />stated in their application that they would have sixty-two spaces and he wondered if these <br />spaces were all theirs to use or if it would conflict with Another Nite's, which usually fills <br />that lot on weekends. Ms. Colquitt responded that Another Nite's business does not pick <br />up until 8 p.m. and that they have leased parking spaces in the Goodwill lot. <br /> <br />Mr. Lieberman noticed that there was not a State of Missouri tax exempt letter. There was <br />a federal tax exempt letter, Mr. Ollendorff said that Goodwill was definitely a non-for-profit <br />organization. Mr. Ollendorff said that he has asked the Finance Director to verify the tax <br />status of this property and the sales taxes on their sales. <br /> <br />Mr. Schoomer said that, from many years back, there had been a conflict on an easement <br />in accessing the drive with the owner to the west.
