? <br /> James – Can we get out at 5 years? – Chuck and Nancy responded that it depends on how the <br />final agreement is negotiated. <br />? <br /> Evelyn – Referred to the information in the package of legal issues sent to the Commission, asked <br />if the city can’t get out of the agreement? Chuck – the standard agreement has different provisions <br />for the lessee and lesser. <br />? <br /> James – Asked John Mulligan, City Attorney, his opinion about the cell tower. – John declined to <br />give his opinion but did discuss the standard lease and what can be negotiated. <br />? <br /> James - Asked Chuck if he would consider a shorter term lease? Chuck said the lease is still open <br />and not completed. <br />? <br /> Francine – What about addendum to the ground structure by other providers and need to add <br />something? – Chuck says they would control the property and they would need to get City approval <br />to put other things on the ground. <br />? <br /> James - Asked how the city handles co-location? John answered that it would be covered in the <br />lease. <br />? <br /> Mary - Asked if there would be any repercussions if we turn it down?– Chuck said that without a <br />current lease there is no repercussions <br />? <br /> Kaye Dryer – She spoke about the towers shelters and disputed the statement by Chuck Beck <br />about radioactivity. At Flynn school there are no signs. Suggested Cunningham Industrial park as <br />a location. Warned that if the city approves this tower it will be forced to take others. There is still <br />studying of microwave radiation and unanswered questions. Citizens cannot discuss the health <br />issues as per the FCC. She said that the city council has been asked to form a task force on cell <br />tower. <br />? <br /> Les – Had four key considerations –1. Health – doesn’t think it is any problem 2. Trend of selling <br />green space for money. 3. Danger to the environment (migration) and 4. Aesthetics <br />? <br /> Evelyn – Can we recommend a task force? Nancy –yes, but the council may not even establish a <br />task force. <br />? <br /> Mary – What about the precedent in the past in other examples? – John there is no legal precedent <br />to the Park Commission. <br />? <br /> Evelyn – Thinks that the citizens concerns should be taken into consideration and likes the idea of <br />a task force. <br />? <br /> Mary – Brought up the staff recommendation and that the benefits outweighed the impacts. <br />Doesn’t feel that this is the same health issue as at a school. <br />? <br /> Motioned by Evelyn to recommend that the City Council establish a task force to expedite the <br />research of all the issues Seconded by James. Motion passed 4 ayes (Les, Evelyn, James, Mary) <br />and 1 No (Carl) <br />? <br /> Carl motioned that the Commission is favorably disposed to the construction of a cell tower at <br />Heman Park as proposed subject to the concern regarding safety, environmental, beautification <br />and lease agreement. Mary seconded. Motion passes unanimously. <br /> <br />7.
