<br />. <br /> <br />. <br /> <br />Minutes - Plan Commission <br />Page 3 <br />April 22, 1987 <br /> <br />for the area west of I-170 between Barby Lane and the south city limits. He <br />stated that the entire tract to be included in the project had been rezoned in <br />late 1985 and early 1986. He stated that the developer wished to resubdivide <br />the parcel into two separate lots corresponding to the two phases of the <br />development. Mr. Bob Leonard, Construction Supervisor for the development, <br />explained to Plan Commission members that the ten previously single family <br />lots that were now included in the "PR-O"-Planned Residential Office District <br />for the Retirement Center were to be eliminated for title purposes. Chairman <br />Hamilton further explained that the subdivision issue before the Plan <br />Commission would not affect the use of the property as proposed, it was merely <br />a legal refinement. Mr. Leonard further explained that the record plat, if <br />approved by the Plan Commission and City Council, would enable the sewer and <br />utility easements to be granted and recorded. Sarah Elwood, Zoning <br />Administrator, stated that she had reviewed the property to be included in the <br />development and that the proposed plat corresponded with the properties that <br />had been rezoned. <br /> <br />Mr. Rice asked why the developers wished to have two lots rather than just one <br />for the entire complex. Mr. Leonard explained that the two lots corresponded <br />to the two phases of development and to the two separate mortgages to be <br />placed on the project. Mr. Rice noted the unusual shape and size of the <br />parcels and asked if there would be a problem with the shape and size of the <br />recorded lots if this project should fail. Mr. Goldman stated that there <br />could be a potential problem with the zoning regulations in determining yards <br />and setbacks for a different development. Mr. McCauley asked why Lot 17, <br />otherwise known as 8637 West Kingsbury Avenue, was not included in the <br />proposed plat. Mr. Leonard replied that it was because Lot 17 had not been <br />included in the rezoning proposal and was not currently included as a part of <br />the project. Mr. McCauley stated that he wanted to make sure that Lot 17 was <br />not isolated from utility services. <br /> <br />Mr. Gene Tischler of 8665 Barby Lane set forth his concerns to Commission <br />members regarding what he perceived as piecemeal rezoning of the several <br />parcels along Barby Lane and West Kingsbury Avenue. He wanted to be sure that <br />conditions placed on the developer under Conditional Use Permit #240 and #241 <br />would be fulfilled before the proJect was built. He was specifically <br />concerned about the requirement that the developer and the City agree on <br />direct public access to Delmar Boulevard from the site. He suggested that <br />this access be constructed before the plat was approved so that Barby Lane and <br />West Kingsbury would not be damaged by the transportation of heavy <br />construction equipment for the development. Chairman Hamilton asked Mr. <br />Leonard what the current prospects were for the required access to Delmar. <br />Mr. Leonard stated that the developers and the City were working with the <br />owners of the Montmartre Building and the Attache Building for granting a <br />public access between the buildings to Delmar. He said that the owners of the <br />two buildings had agreed in principle to deeding this property to the City. <br />Mr. Tischler again suggested that the street be paved before construction at <br />the site was under way so that the new street could be used for transportation <br />and removal of heavy equipment.
