Public Works <br />personnel had taken pictures of the streets surrounding the development to <br />document their condition; the developer has agreed to repair any damage to the <br />streets during and after construction. Mr. Daniel Talonn of 8661 Barby Lane <br />asked if the developer had complied with the other conditions of their permit. <br />Mr. Goldman replied that the working drawings which were submitted with an <br />application for a building permit were being reviewed to make sure that they <br />were in substantial conformance with the Use Permit issued to the developer. <br />Mr. Leonard stated that residents of the area were welcome to visit the <br />construction office to review the scale model of the Retirement Center. The <br />construction office is currently located at 8636 Barby Lane. <br /> <br />Mr. Rice moved that the Plan Commission approve the record plat for One <br />McKnight Place Retirement Development in accordance with the proposed plat <br />submitted to the Commission and dated April 15, 1987. Mr. Kendall seconded <br />the motion which passed by a vote of 4-0. <br /> <br />APPLICATION FOR CONDITIONAL USE PERMIT - 7701 OLIVE BOULEVARD, CARRY-OUT <br />RESTAURANT USE <br /> <br />Chairman Hamilton stated that the Plan Commission had received an application <br />for a Conditional Use Permit by Mr. Kerry McDaniel in order to use the <br />property at 7701 Olive Boulevard for a carry-out type ice cream parlor. Mr. <br />McDaniel stated that his contract to purchase the property was contingent upon <br />the Plan Commission and City Council approval of the carry-out use. He stated <br />that barring approval of the ice cream parlor use, he would propose to open up <br />a florist shop as a permitted use in the same location. Chairman Hamilton <br />asked Mr. Goldman for his comments on the application. Mr. Goldman stated <br />that the small properties on the north side of Olive Boulevard Just west of <br />North and South Road presented a problem because of their small size and <br />parking allotment. It was within the City's interest not to encourage <br />so-called "litter generators;" the Comprehensive Plan called for consolidation <br />of these properties into larger parcels. He stated that the property in <br />question had previously been a gas station and was later used as office space. <br />The current state of the building would require a lot of work to bring it up <br />to code. The pavement would need a lot of work in order to provide the <br />required amount of parking requirements for the proposed use. He was <br />concerned with the proximity of the building to the right of way and potential <br />problems of traffic access. He suggested that the Olive Boulevard frontage <br />not include any parking or vehicular access to the property. Mr. McDaniel <br />said that his backers had expressed their support in bringing the property up <br />to code. Mr. McDaniel stated that he has a concession company of his own and <br />would buy ice cream from either Swensen's or Prairie Farms. <br /> <br />Mr. McCauley expressed his concern over the probable "litter generating" use. <br />Mr. McDaniel said that he would provide one employee per shift for clean-up <br />purposes only. Chairman Hamilton suggested that Mr. McDaniel and Mr. Goldman <br />meet to discuss the suggested conditions for the proposed use. <br />
