Ms. Schuman agreed that a valid concern <br />of communities was that of pedestrian safety and felt that, with regard to <br />issues of public convenience, the Plan Commission could respond to market <br />decisions which abandon a portion of community needs. Ms. Schuman and Mr. <br />Marsh agreed that a small kiosk selling only snack-type foods presented more <br />vehicle/pedestrian conflict than a larger convenience store catering to an <br />adult grocery market. Mr. Kendall stated that his concerns included the <br />potential traffic flow problems created by the car wash. After an extended <br />discussion, Mr. Marsh moved that the Plan Commission recommend approval of <br />Shell's application for a Conditional Use Permit subject to the fOllowing <br />conditions: <br /> <br />1. A detailed landscaping plan including retaining wall and screen walls <br />shall be submitted to the Director of Planning for review and all <br />landscaping shall be installed and maintained in accordance with the <br />approved plan. <br />2. Signs shall be in strict compliance with Article 7 of the Zoning Code. <br />3. Hours of operation for the car wash shall be established with an opening <br />time no earlier than 6 a.m. and a closing time no later than 10 p.m. <br />4. Doors for public access to the food mart shall be locked no later than <br />10 p.m. each evening and shall remain locked until at least 6 a.m. the <br />next morning. <br />5. The operator shall regularly police the property and the adjacent <br />property to the east to remove litter and debris. <br />6. A sign indicating "No Left Turn" shall be installed near the eastermost <br />exit on to Olive Boulevard. <br /> <br />Ms. Kreishman seconded the motion. After further discussion, the motion was <br />passed by a vote of 6-1. Chairman McCauley stated to the applicants that <br />the application and Plan Commission recommendation would be forwarded to the <br />City Council for its consideration on October 5, 1987. <br /> <br />AMENDMENTS TO TRUCK PARKING REGULATIONS IN THE MUNICIPAL CODE AND ZONING <br />CODE. <br /> <br />Mr. Adams conducted a review of the proposed changes to Chapter 21 of the <br />Municipal Code and to Section 34-52 of the Zoning Code with regard to truck <br />parking and parking and storage of major recreational equipment on private <br />property. The Plan Commission had been charged with the duty of reviewing <br />the proposed changes to Section 34-52 of the Zoning Code and reporting back <br />to the the City Council Sub-Committee on Truck Parking Regulations by the <br />end of the year. Mr. Goldman stated that Plan Commission members had been <br />sent an outline of the suggested changes to the Zoning Code as well as a <br />memorandum by the Zoning Administrator detailing various cities' regulations <br />regarding parking on private property in residential and commercial <br />districts. After several questions and grammatical corrections, Chairman <br />McCauley suggested that the Plan Commission review the proposal after <br />Planning Staff made the suggested changes. Further discussion was postponed <br />until the regular October Plan Commission meeting. <br />
