She stated that she had had a <br />number of problems with people parking and walking on her lawn. Mr. Leonard stated <br />that the developers had provided as many on-site parking spaces as was possible and <br />stated that he constantly reminded workers to be considerate of the neighborhood, but <br />that construction was a temporary situation. Mr. Bernard Becker of 8655 West <br />Kingsbury asked if the house at 8630 Barby Lane would be demolished. Mr. Leonard <br />stated that it would be demolished once the Phase II project was under way. Mr. <br />Charles Collins of 8639 Barby Lane expressed his concern also for the amount of <br />construction parking in the neighborhood and stated that the street was always very <br />dirty from construction traffic. Mr. Leonard stated that the street was cleaned <br />every Friday or Saturday by the developer, and he would keep up his efforts to <br />maintain a clean neighborhood especially in muddy conditions. <br /> <br />After lengthy deliberations regarding the appropriate right-of-way or curb line <br />setback from Barby Lane, Mr. Washington moved that the Plan Commission recommend <br />approval of the application for a Conditional Use Permit amendment by Mr. Charles <br />Deutsch and Mr. David Smith dba the McKnight Place Partnership for the Phase II <br />assisted and skilled nursing care facility, subject to the following conditions: <br /> <br />1. A detailed landscaping plan shall be submitted and approved by the Planning <br />Director and landscaping shall be installed and maintained in general conformity <br />to the approved plan. <br />2. All driveways and parking areas shall be edged with Portland Cement concrete <br />curbs. <br />3. Guard houses shall be of permanent construction matching the principal bUildings. <br />4. All exterior mechanical equipment shall be effectively screened. <br />5. Storm water design criteria calculations shall be submitted for review and <br />approval of the City staff and MSD; and a storm water drainage system shall be <br />installed and maintained in accordance with the approved plan. <br />6. Fire hydrants shall be installed at locations approved by the Fire Marshal. <br />7. Final driveway and parking lot layouts shall be reviewed and approved by the Fire <br />Marshal to ensure there will be adequate maneuvering space for fire equipment. <br />8. The building shall be set back at least ten (10) feet from the parking areas and <br />driveway, with walls containing patient room windows set back at least fifteen <br />(15) feet from the parking areas and driveway, except bay windows shall be <br />permitted to project no more than three (3) feet into the required setback areas. <br />9. The portion of the Barby Lane right-of-way between the street pavement and the <br />south right-of-way line shall be landscaped and maintained by the applicant or <br />their successors in interest. <br />10. In all other respects, the project shall be constructed and maintained in general <br />conformity to the application documents as submitted with the development <br />standards of Section 34-34.7 of the Zoning Code modified to permit the right-of- <br />way setback and property line setback shown on the site plan. <br /> <br />Mr. Kendall seconded the motion. After further discussion, Mr. Rice called for a <br />vote on the motion which passed by a vote of 3-1 with one abstention. <br />
