<br />. <br /> <br />. <br /> <br />Minutes - Plan Commission <br />Page 4 <br />October 26, 1988 <br /> <br />APPLICATION FOR CONDITIONAL USE PERMIT #269 - DUBBLES RESTAURANT AT 7290 OLIVE <br /> <br />Ms. Elwood reminded Commission members that on September 28, 1988, the Plan <br />Commission voted unanimously to table the Conditional Use Permit application by <br />Mr. Terry Barton for permission to construct and operate a drive-in restaurant at <br />7290 Olive Boulevard. The Commission conditioned its vote on receipt, by October <br />17, 1988, of the following information by the applicant: <br /> <br />1. A survey of the site prepared by a registered land surveyor. <br /> <br />2. A correctly drawn and dimensioned site plan. <br /> <br />3. A report of an accredited traffic engineer regarding a vehicular circulation <br />and access to the site. <br /> <br />4. A report of a registered professional engineer regarding compliance with the <br />floodplain ordinance. <br /> <br />5. Topographic information on the site plan showing the limits of the floodway <br />and proposed new grades. <br /> <br />6. Drawings of all signs that will appear on the site or on the building. <br /> <br />7. A signed statement from the applicant agreeing that if the business is closed <br />for a period of 30 days, all signs will be removed from the premises and if <br />the business is closed for a period of 120 days, the building and trash <br />enclosure will be removed from the site. <br /> <br />Other than sign drawings for the proposed site, the Planning Department had <br />received no further correspondence from the applicant. She informed the Plan <br />Commission that it must make a recommendation on the application at this meeting <br />in order to comply with the requirements of Zoning Code Section 34-65.6. Plan <br />Commission members agreed that the proposed use was an appropriate one for the <br />site but did not want to make a favorable recommendation to the City Council <br />absent complete site information. Mr. Marsh moved that the Plan Commission <br />recommend denial of Dubble's Conditional Use Permit #269 for location of a <br />drive-in restaurant at 7290 Olive Boulevard. Ms. Kreishman seconded the motion <br />which passed by a vote of 6-0. Mr. Kendall and Chairman McCauley suggested that <br />Ms. Elwood contact Mr. Barton and inquire as to his continued interest in the <br />property, if any. <br /> <br />ADJOURNMENT <br /> <br />The meeting adjourned at 8:55 p.m. <br />
