Mr. Barton explained that <br />he and Mr. Schwartzkopf had received a copy of the December 2, 1988, <br />Planning Director's report on the application. He presented Commission <br />members with a revised site plan dated December 6, 1988, which included many <br />of the Planning Director's recommendations for site development. The refuse <br />pad and box were now shown on the plan at the Midland side of the building, <br />placed well outside of the floodway and convenient for servicing. A <br />crosswalk and sidewalk had been added to the plan to accommodate pedestrian <br />access to the building. Dubbles did not plan to provide an outdoor picnic <br />area and, therefore, did not indicate how one would be accessible to the <br />walkway system or how it would be enclosed. More details regarding <br />landscaping and curb locations had been provided on the amended plan. Mr. <br />Barton indicated that he would be happy to discuss any issues regarding <br />signage with the Commission. A signed statement had accompanied the <br />application to the effect that if the business is closed for a period of 30 <br />days, all signs shall be removed from the premises, and if the business is <br />closed for a period of 120 days, the building and trash facilities shall be <br />removed from the site. Finally, Mr. Schwartzkopf indicated that the <br />location of the service windows on the building had been moved closer to <br />Midland Boulevard to facilitate stacking of cars on site and to eliminate <br />the refuse box on the Olive Boulevard side of the building. <br /> <br />Chairman McCauley asked the applicant to respond to questions from <br />Commission members. The Chairman asked if the State and County <br />jurisdictions had approved the curb cuts on both Olive and Midland. Mr. <br />Barton replied that these approvals had been given in full consideration of <br />the vehicle stacking potential and traffic circulation. Ms. Kreishman <br />confirmed that the location of the driveway off Midland Boulevard was <br />located at a point further south than it had been in a previous submittal. <br />Mr. Safe asked if the refuse box would be screened from public view. Mr. <br />Barton replied that the box would be screened by a site-proof fence. <br />Chairman McCauley noted the evidence of compliance with the floodplain <br />regulations and the immediately pressing need to remove the in-ground fuel <br />tanks. <br /> <br />Chairman McCauley declared the public hearing open; however, as no <br />interested parties were present to speak, the hearing was closed. <br /> <br />After further discussion, Ms. Kreishman moved that the Plan Commission <br />recommend approval of the application for Conditional Use Permit #270 <br />subject to the following conditions: <br /> <br />1. The plan shall include a continuous walk along the north side of the <br />northernmost drive from Midland Boulevard to Olive Boulevard. <br /> <br />2. If an outdoor eating or picnicking area is provided, it shall be <br />directly accessible from the walkway system and enclosed by a low wall <br />or a low hedge. <br /> <br />3. If the business is closed for a period of 30 days, all signs shall be <br />removed from the premises, and if the bUilding is closed for a period of <br />120 days, the building and trash facilities shall be removed from the <br />site. <br />
