<br />. <br /> <br />. <br /> <br />Minutes - Plan Commission <br />Page 5 <br />April 26, 1989 <br /> <br />REQUEST FOR SUBDIVISION - THE VILLAGE OF UNIVERSITY PLACE. PLAT I, RECORD PLAT <br /> <br />Chairman McCauley called on Sarah Elwood, Zoning Administrator, to review the staff <br />report on the above-referenced record plat for its compliance with Chapter 29, the <br />city's Subdivision Ordinance. Ms. Elwood stated that the proposed Record Plat for <br />Plat I of the Village of University Place complies with the conditions previously set <br />for the development by the city under Conditional Use Permit #266A and Site Plan <br />Review #1202. She indicated that the developers and the registered land surveyors had <br />resolved any issues pertaining to minimum lot width, street and alley widths and radii <br />for all rounded corners, adequate labeling of the document's various sheets, as well <br />as sidewalk improvements outside the right-of-way along Balson Avenue. Mr. Goldman <br />agreed that these issues had been resolved but believed that the Record Plat for Plat <br />I should reference the four acre common open space to the north as that area was part <br />of the Conditional Use Permit approval as well as a sanction of the approved density <br />of the development. Mr. Goldman also suggested that Mr. Bruno and Mr. Conner review <br />the indentures submitted with the plat and add or correct the following: <br /> <br />1. Definition of "Sidewalks" - should not exclusively refer to those "labeled" on <br />the plat; not all sidewalks are so labeled. <br /> <br />2. The subdivision name should be consistent throughout the document. <br /> <br />3. A statement prohibiting any enclosed structure in the area between an established <br />building line and any streets or alleys. <br /> <br />After a brief discussion, Mr. Marsh moved that the Plan Commission approve the <br />subdivision of property in accordance with the plat entitled The Village of University <br />Place-Plat I, subject to the following conditions: <br /> <br />1. Necessary changes to the "Indenture of Covenants, Conditions and Restrictions for <br />The Village of University Place, University City, Missouri" shall be made <br />including: <br /> <br />a. Consistent reference to the name of the subdivision, "The Village of <br />University Place" shall be used throughout the Indenture. <br /> <br />b. The definition of "Sidewalks" shall be changed so as not to refer to those "so <br />labeled on the plat." <br /> <br />c. A statement shall be added to the Indenture precluding the construction of any <br />enclosed structure in areas between a building line as shown on the Plat and <br />any street or alley. <br /> <br />2. The pages which depict the total document for "The Village of University <br />Place-Plat I" shall be labeled "Sheet 1 of 2" and "Sheet 2 of 2" in order to <br />adequately describe the complete document to be recorded. <br /> <br />3. A legal description of the "Common Open Space" shall be recorded as a part of Plat <br />I in order to legally provide such open space for the lots included in Plat I. <br /> <br />Mr. Kendall seconded the motion which passed by a vote of 7-0. <br />
