The City Council <br />has stated, in its approval of site Plan Review #1157A for <br />development of the Center, that any future development of the <br />property may not take place until a separate Site Plan Review for <br />such development is approved by the Council. It is not the City's <br />or the developer's intent to further develop either lot, much of <br />which is floodplain. Ms. Elwood explained that the Sewer District <br />easements depicted on the resubdivision plat have changed since the <br />original "Westover Subdivision" submittal in January, 1989. The <br />Sewer District did not accept the easements as proposed in the <br />original plat and all previous sewer easements have been vacated <br />and recorded as shown on the current plat. Ms. Elwood had a <br />development plan for the entire site should it help members review <br />the proposal. <br /> <br />Mr. Foxworth asked for clarification of the three lots which are to <br />make up the Westover Center site. Ms. Elwood indicated Lot 1 on <br />which the Aldi grocery store is now built, proposed Lot 2A on which <br />the retail center is being constructed, and proposed Lot 2B which <br />will most likely remain undeveloped. Mr. Safe asked why the Lot 2B <br />would likely remain undeveloped. Ms. Elwood replied that most of <br />Lot 2B is designated floodplain. Mr. Safe then moved that the Plan <br />Commission approve the "Resubdivision Plat of Lot 2 into Lot 2A and <br />Lot 2B of Westover Center." Mr. Marsh seconded the motion which <br />passed by a vote of 6-0. <br /> <br />APPLICATION FOR DESIGNATION OF LOCAL HISTORIC LANDMARK - TIVOLI <br />BUILDING. 6346-70 DELMAR BOULEVARD <br /> <br />Chairperson Kreishman informed those present that, at its last <br />meeting, the Plan Commission had reviewed an application for <br />designation of the Tivoli Building, located at 6346-70 Delmar <br />Boulevard, as a local historic landmark. The Commission had tabled <br />the application at the request of the City Council which sought to <br />resolve legal issues relating to the property. The Chairperson <br />asked if City Planning Staff had any information on the progress of <br />the City Council's proceedings. Ms. Elwood stated that the City <br />Manager wished to inform the Commission that the Council had wanted <br />to obtain a legal opinion as to whether designation of the building <br />or the historical designation process would interfere with the <br />City's interest in obtaining the building through eminent domain. <br />Ms. Elwood stated that the City Manager apologized for not having <br />resolved the issue to date, but believed the Plan Commission should <br />move forward with its duty to consider the application by the terms <br />prescribed in the ordinance. Ms. Elwood understood from the City <br />Manager that the building owner had no opposition to the City <br />obtaining the building by legal means; however, the issue of <br />compensation would be reviewed judicially. <br /> <br />Ms. Elwood also reviewed for members the Memorandum distributed in <br />advance of the meeting which detailed the Commission's options in <br />
