<br />Minutes - Plan cojllssion <br />June 27, 1990 <br />Page 3 <br /> <br />. <br /> <br />raised $28,000 as a downpayment on the property and purchased the <br />property in January of 1990 with a $95,000 mortgage. Reverend <br />Buckner explained that the Church had spent $18,000 on improving <br />the parking lot and removing the marquee on the building and felt <br />it was foolish to spend any more money on property the Church did <br />not own at the time. He admitted that he was due in Court on July <br />20, 1990, to answer charges of occupying the premises without a <br />permit, but promised the Commission that all work on the building <br />could be complete by August 10, 1990, when the Church would host, <br />along with other area churches, a Midwest Conference of their <br />denomination. <br /> <br />Chairperson Kreishman asked if Commission members had any questions <br />of the applicant or the Zoning Administrator. Mr. Kendall asked if <br />the church had any contracts or updated drawings for the work <br />required under its previous Use Permit. Reverend Buckner replied <br />that the Commission had received the same drawings he had <br />previously submitted to indicate what work would be done on the <br />building; he believed that these drawings had already been <br />approved. Mr. Kendall asked Ms. Elwood what the City's position <br />would be if the Commission were to table the current application or <br />deny it without prejudice. Ms. Elwood replied that if the Church <br />continued to violate city law, the position of the city <br />administration and planning staff would remain the same; the city <br />is opposed to the issuance of any further Conditional Use Permit <br />and will continue to cite the Reverend and his congregation for <br />occupancy and other violations. Mr. Kendall stated to Reverend <br />Buckner that three years was usually enough time to see whether a <br />tenant or property owner was committed to compl iance with the <br />City's laws and property maintenance; he further stated that he <br />would not support a position where the City would continue to go <br />along with verbal promises for building renovations which would <br />never be completed. Mr. Kendall continued by saying that he <br />recalled the previous meetings when Reverend Buckner had appeared <br />before the Plan Commission. He had understood at those times that <br />the Living Word Church would be receiving financial assistance from <br />its home organization, but no progress had been made to improve the <br />appearance of the property or to indicate that the church was a <br />good neighbor of the businesses and other property owners along <br />Olive Boulevard. <br /> <br />Chairperson Kreishman opened the public hearing on the Conditional <br />Use application; however, as no member of the public was present to <br />speak to this issue, the Chairperson declared the public hearing <br />closed. <br /> <br />Ms. Ratner and Mr. Foxworth both shared Mr. Kendall's concerns. <br />Mr. Safe clarified with Ms. Elwood that the church, as owner of the <br />property, could apply for and obtain building permits to work on <br />the exterior of the building and improve its appearance. Ms. <br />Elwood stated that such permits could be issued if the details <br />contained in the application met both the zoning and building codes <br />
