He stated that the restaurant would primarily be a <br />carry-out location for fast food fish. <br /> <br />Chairperson Kreishman asked Ms. Elwood to review the staff report <br />on the application and also to locate the proposed carry-out <br />restaurant and other proposed businesses on the map of the Westover <br />Center. Ms. Elwood located for Commission members the businesses <br />that had applied for or been issued business occupancy permits. <br />She located the proposed Fish & Such restaurant at the west end of <br />the Center, the fourth unit from the end. Ms. Elwood reviewed the <br />staff report with the three proposed conditions regarding signage, <br />adequate trash facilities for the restaurant and litter prevention. <br />Planning staff recommended approval of the application. <br /> <br />Commission members asked a few questions of Mr. Carradine. Mr. <br />Marsh asked if the proposed hours of operation were the same as <br />those of the other restaurants in the Center. Ms. Elwood replied <br />that the proposed hours for Fish & Such were shorter than for the <br />other restaurants, but that this was not a problem. Mr. Safe asked <br />if, for previous restaurant applications at the Westover Center, <br />the Commission and City Council had not already required additional <br />trash facilities. Ms. Elwood recalled previous discussion about <br />the trash facilities but knew that specific locations had not been <br />approved or required. <br /> <br />Chairperson Kreishman opened the scheduled public hearing on the <br />application. As no one was present to speak on the application, <br />the Chairperson closed the public hearing. <br /> <br />After a brief discussion, Mr. Marsh moved <br />application for a Conditional Use Permit be <br />approval subject to the following conditions: <br /> <br />1. Signs shall be in strict compliance with the sign code <br />provisions of the Zoning Code. <br /> <br />that Ms. Harris' <br />recommended for <br /> <br />2. Should the City determine that additional centralized trash <br />facilities are needed, they shall be provided near the <br />restaurant to accommodate this need. <br /> <br />3. The operator shall regularly police the site and the area <br />adjacent to the restaurant to remove litter generated by the <br />business. <br /> <br />Mr. Kendall seconded the motion which passed by a vote of 6-0.
